<br /> G. Developer may apply for or assist in applying for a <br /> water transport permit from the Edwards Underground Water <br /> District for water to be supplied to the District. Developer <br /> agrees that should the District be created with water service to <br /> be provided by the City, that such permit, if received, shall be <br /> an asset of the District which would transfer to the City upon <br /> annexation or at such time as City requires such permit to serve <br /> the area within the District. <br /> H. Developer agrees to donate to the appropriate <br /> governmental agency Twenty-five Thousand Dollars ($25,000.00) <br /> towards the construction of a bridge or overpass over IH - 3 5 near <br /> or adjacent to the District, at the time of funding for <br /> construction. <br /> I. Any failure on the part of Developer or its <br /> successors or assigns to obtain the required permits, approvals, <br /> inspections, or pay the required fees to the City shall subject <br /> Developer or its successors or assigns to stop-orders requiring <br /> the cessation of any further construction or related operations <br /> until such payments, permits, reviews, approval, or inspections <br /> are acquired or completed. <br /> J. Developer covenants and agrees that, within thirty <br /> (30) days following the election confirming the creation of the <br /> District or prior to any platting within the District, whichever <br /> occurs first, it will file a set of restrictive covenants or deed <br /> restrictions in the Deed Records of Hays County, in a form <br /> approved by the City Attorney, to ensure compliance with the <br /> provisions of Article IX of this Agreement. Such covenants and <br /> restrictions shall run with the land and be binding upon <br /> Developer and all successors and assigns until dissolution of the <br /> District or for forty ( 40) years, whichever comes first. <br /> Construction on the property within the District shall be in <br /> compliance with such covenants and restrictions which shall <br /> include, but not be limited to (1) requir ing that the standards <br /> set forth in the City's building codes, including but not limited <br /> -24- <br />
