<br /> to the "Building Code, Plumbing Code, Air Conditioning/Heating <br /> Code, Electrical Code, Fire Code and Gas Code as they exist and <br /> as they may be amended from time to time, be met, (2) requiring <br /> compliance with the standards and criteria set forth in the <br /> City's Subdivision Ordinance and Zoning Ordinance for applicable <br /> land uses as shown on the Land Plan, and (3) requiring compliance <br /> with the Landscape Ordinance and Interim Drainage and Erosion <br /> Control Ordinance as they may be amended from time to time. <br /> In addition, such covenants and restrictions shall put <br /> builders or developers within the District on notice that (1) <br /> they will be required to pay the in-city plan review and <br /> inspection fees for review of all buildings planned or under <br /> construction, and (2) any failure on the part of builders or <br /> developers to obtain the required permits, approvals, <br /> inspections, or pay the required fees to the City shall subject <br /> the builder or developer to stop-orders requiring the cessation <br /> of any further construction or related operations until such <br /> payments, permits, reviews, approvals, or inspections are <br /> acquired or completed. <br /> Further, the covenants and restrictions shall put the <br /> owners of all cable TV systems to be operated within the District <br /> on notice that they are required to provide the City of San <br /> Marcos with all information which would normally be required by <br /> the City to complete a franchise agreement. Such information is <br /> to be initially submitted at least thirty ( 30) days before <br /> operations are scheduled to begin within the District, and <br /> updated from time to time as changes occur. The covenants and <br /> restrictions may state that such owners are not required to make <br /> payment to the City of any fees or charges incident to the <br /> operation of any such cable TV system prior to annexation of the <br /> District by the City. <br /> Developer hereby makes a non-exclusive assignment of its <br /> right to enforce these covenants and restrictions to the City. <br /> Such assignment to the City shall not prevent Developer from also <br /> enforcing such covenants and restrictions. <br /> -25- <br />
