K. Developer agrees to participate in an affordable housing plan for low income families and individuals which the City may develop in the future, and amend from time to time, with such plan to also be applied within the City and within its ETJ to the extent authorized by law. L. The owners of all cable TV systems to be operated within the District shall provide the City of San Marcos all information which would normally be required by the City to complete a franchise agreement. This information shall be submitted at least thirty (30) davs before operations are scheduled to begin in the District. This information must be updated from time to time as changes occur. This provision does not require the payment to the City of any fees or charges incident to the operation of any cable TV system. M. In the event that the District is not created, the intention and offer to restrict, dedicate and contribute expressed in this Article shall not be effective, but shall be of no force or effect. ARTICLE X ASSIGNMENT OF AGREEMENT Developer, its successors and assigns may, from time to time, transfer, convey or assign all or any part of its rights and obligations under this Agreement with respect to all or any part of the land within the District owned by it. Upon approval by the City Council of the City of the assignee or assignees, which approval shall not be unreasonably withheld, and provided that the assignee or assignees assume the liabilities, responsibilities and obligations of the assignor under this Agreement, the party assigning its rights and obligations under this Agreement, shall be released from the liabilities, responsibilities and obligations hereof to the extent of the land involved in such assignment or assignments or to the extent otherwise approved by the City.
