<br /> K. Developer agrees to participate in an affordable <br /> housing plan for low income families and individuals which the <br /> City may develop in the future, and amend from time to time, with <br /> such plan to also be applied within the City and within its ETJ <br /> to the extent authorized by law. <br /> L. The owners of all cable TV systems to be operated <br /> within the District shall provide the City of San Marcos all <br /> information which would normally be required by the City to <br /> complete a franchise agreement. This information shall be <br /> submitted at least thirty (30) davs before operations are <br /> scheduled to begin in the District. This information must be <br /> updated from time to time as changes occur. This provision does <br /> not require the payment to the City of any fees or charges <br /> incident to the operation of any cable TV system. <br /> M. In the event that the District is not created, the <br /> intention and offer to restrict, dedicate and contribute <br /> expressed in this Article shall not be effective, but shall be of <br /> no force or effect. <br /> ARTICLE X <br /> ASSIGNMENT OF AGREEMENT <br /> Developer, its successors and assigns may, from time to <br /> time, transfer, convey or assign all or any part of its rights <br /> and obligations under this Agreement with respect to all or any <br /> part of the land within the District owned by it. Upon approval <br /> by the City Council of the City of the assignee or assignees, <br /> which approval shall not be unreasonably withheld, and provided <br /> that the assignee or assignees assume the liabilities, <br /> responsibilities and obligations of the assignor under this <br /> Agreement, the party assigning its rights and obligations under <br /> this Agreement, shall be released from the liabilities, <br /> responsibilities and obligations hereof to the extent of the land <br /> involved in such assignment or assignments or to the extent <br /> otherwise approved by the City. Neither the District nor the <br /> City shall assign this Agreement without written consent of each <br /> -26- <br />
