<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE
<br /> CITY OF SAN MARCOS, TEXAS, ANNEXING TO
<br /> SAID CITY A TRACT OF LAND CONTAINING
<br /> 20.48 ACRES, MORE OR LESS, OUT OF THE
<br /> J.M. VERAMENDI SURVEY NO. ONE ( 1 ), IN
<br /> HAYS COUNTY, TEXAS, BEING A PORTION OF
<br /> THAT TRACT DESCRIBED AS 195.677 ACRES IN
<br /> A DEED OF TRUST FROM DR. BRYAN WILDENTHAL
<br /> TO JIM R. SMITH DATED JULY 13, 1981, AND
<br /> RECORDED IN VOLUME 272, PAGE 409 OF THE
<br /> HAYS COUNTY DEED RECORDS, SAID LAND BEING
<br /> LOCATED WITHIN THE EXTRATERRITORIAL
<br /> JURISDICTION OF SAID CITY AND LYING
<br /> ADJACENT TO PRESENT CITY BOUNDARIES;
<br /> APPROVING A SERVICE PLAN FOR SAID TRACT;
<br /> EXTENDING THE BOUNDARY LIMITS OF SAID
<br /> CITY SO AS TO INCLUDE SAID TRACT;
<br /> GRANTING TO THE INHABITANTS OF SAID TRACT
<br /> ALL THE RIGHTS AND PRIVILEGES OF OTHER
<br /> CITIZENS OF SAID CITY; BINDING SAID
<br /> INHABITANTS BY ALL OF THE ACTS AND
<br /> ORDINANCES, RULES AND REGULATIONS OF SAID
<br /> CITY; AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, the City Council of the City of San Marcos,
<br /> Texas, provided an opportunity for all interested persons
<br /> to be heard at two (2) public hearings, held on
<br /> September 23 , 1985, and SeYJtember 24 , 1985,
<br /> to consider the proposed annexation by the City of San
<br /> Marcos, Texas, of 20.48 acres of land, more or less, out
<br /> of the J.M. Veramendi Survey No. One (1) in Hays County,
<br /> Texas, being a portion of that tract described as 195.677
<br /> acres in a Deed of Trust from Dr. Bryan Wildenthal to Jim
<br /> R. Smith dated July 13, 1981, and recorded in Volume 272,
<br /> Page 409 of the Hays County Deed Records, Hays County,
<br /> Texas, and being more particularly described by metes and
<br /> bounds as follows:
<br /> BEGINNING at an 3/4" iron pipe found at the
<br /> north corner of the aforereferenced Smith
<br /> tract, the east corner of that tract described
<br /> as 70.58 acres in a deed from the State of
<br /> Texas to San Marcos Consolidated Independent
<br /> School District dated February 21, 1957 and
<br /> recorded in Volume 170, Page 159 of the Hays
<br /> County Deed Records, in the southwest line of
<br /> the 80' right-of-way known as F.M. Highway No.
<br /> 621, for the north corner of this tract;
<br /> THENCE leaving the PLACE OF BEGINNING as shown
<br /> on plat #21738-84-b prepared for San Marcos
<br /> Consolidated Independent School District by
<br /> Byrn & Associates of San Marcos, Texas, with
<br /> the common lines of the Smith tract and F.M.
<br /> Highway No. 621 the following two courses;
<br /> 1. S39°09'26"E 289.12 feet to a concrete
<br /> highway monument at engineers station
<br /> no. P.C. 35+63.2, as shown on highway
<br /> strip map control #987 Section 3, Job
<br /> 1,
<br /> 2. with a right breaking curve, having
<br /> the following characteristics:
<br /> Delta=11°16130", Radius=1105.91 feet,
<br /> Arc=217.63 feet, and a chord bearing
<br /> S33°36126"E 217.28 feet to an 1/2"
<br /> iron rod set for the east corner of
<br /> this tract, from which a concrete
<br /> highway monument at engineers station
