<br /> -12- <br /> after the termination of this Agreement to remove all of Lessee's <br /> personal property. It is hereby agreed by the parties hereto that <br /> the aircraft storage hangar and parking area to be constructed in <br /> accordance with the terms and conditions set forth herein constitute <br /> improvements of a permanent nature and the title and possession thereto <br /> shall vest immediately in Lessor upon termination of this Agreement <br /> in accordance with the terms and conditions set forth in Article II <br /> hereof. <br /> XXIII. <br /> Lessee shall not assign or sublease this Agreement of Lease <br /> without first obtaining the prior written approval of the Lessor, <br /> which approval shall not be unreasonably withheld. No sublease <br /> or assignment of lease shall ever be given except for the purposes <br /> and uses authorized hereby. However, in the event this Agreement <br /> of Lease is assigned as collateral by Lessee for the benefit of <br /> creditors to allow for the completion of the improvements upon the <br /> leased real estate herein described, then, upon Lessee's default <br /> thereunder, the beneficiary of such collateral assignment shall be <br /> given the same rights, titles and privileges as the original Lessee <br /> including but not limited to the opportunity to cure any existing <br /> or future defaults in this Agreement and may, upon Lessor's written <br /> approval, which will not be unreasonably withheld, sublease said <br /> premises to a qualified and acceptable party to continue to operate <br /> the facilities in conjunction with approved functions and operations <br /> as described by the terms and conditions of this Agreement. <br /> XXIV. <br /> Lessee shall not furnish to any other person or entity any <br /> office, hangar, storage space, field storage privilege or any other <br /> right or privilege in or on any Airport property of Lessor other than <br /> that provided for herein without the written consent of Lessor. <br /> XXV. <br /> Lessee covenants and agrees to furnish a copy of all San Marcos <br /> Municipal Airport rules and regulations to all its aircraft storage <br /> hangar and parking area lessees. Lessee further agrees to abide by <br /> such rules as may be established from time to time by Lessor <br /> pertaining to the use of the Airport premises hereby leased to Lessee. <br />
