<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF
<br /> THAT ORDINANCE WHICH REGULATES AND RESTRICTS
<br /> THE LOCATION AND USE OF BUILDINGS, STRUCTURES
<br /> AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54)
<br /> BY CHANGING THE ZONING OF 13.425 ACRES, MORE
<br /> OR LESS, OF LAND AREA BEING TWO TRACTS OF LAND
<br /> IN THE J. M. VERAMENDI LEAGUE NO. 2 IN SAN MAR-
<br /> COS, HAYS COUNTY, TEXAS, BEING A PORTION OF
<br /> THAT 18.2 ACRE TRACT NO. 3 DESCRIBED IN A
<br /> DEED FROM F. C. DAVIS, ET UX, TO CHARLES A.
<br /> ZUNKER DATED MAY 31, 1946 AND RECORDED IN
<br /> VOLUME 135, PAGE 34 OF THE HAYS COUNTY DEED
<br /> RECORDS, A/K/A 1111 THORPE LANE, FROM "M"
<br /> (SINGLE, DUPLEX, MULTIPLE FAMILY DWELLINGS
<br /> AND NEIGHBORHOOD BUSINESS) TO "c" (COMMERCIAL
<br /> DISTRICT).
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />SECTION 1. That the following described parcel of real property lo-
<br />cated in San Marcos, Hays County, Texas, which is presently zoned
<br />"M" (Single, Duplex, Multiple Family Dwellings and Neighborhood
<br />Business) henceforth shall be rezoned as follows:
<br />13.425 acres, more or less, of land area being two tracts of land
<br />in the J. M. Veramendi League No. 2 in San Marcos, Hays County,
<br />Texas, being a portion of that 18.2 acre Tract No.3 described in
<br />a Deed from F. C. Davii, Et Ux, to Charles A. Zunker dated May 31,
<br />1946 and recorded in Volume 135, Page 34 of the Hays County Deed
<br />Records, and being more particularly described by metes and bounds
<br />as follows:
<br />TRACT NO. 1, 4.453 ACRES: BEGINNING at an iron rod set for the East
<br />corner of the aforereferenced Zunker Tract No. 3 and the herein
<br />described tract for the South corner of that 20.76 acre tract of
<br />land described in a Deed from Doyle S. Peters, Trustee, to the
<br />Housing Authority of the City of San Marcos, Texas, in the North-
<br />west line of Thorp Lane;
<br />THENCE leaving the PLACE OF BEGINNING and the Housing Authority
<br />tract as shown on that plat numbered 21037-83-a as prepared during
<br />March 1983 for Robbie Zunker by Dabney-Byrn and Associates, Inc. of
<br />San Marcos, Texas, with the common line of the Zunker Tract No. 3,
<br />and Thorp Lane S. 45° 45' 00" W. 250.00 feet to an iron rod for the
<br />South corner of this tract, and for the East corner of that 1.115
<br />acre tract of land described in a Deed from Robbie Mae Zunker, to
<br />Southwest Texas State University dated January 7, 1983 and record-
<br />ed in Volume 387, Page 68 of the Hays County Deed Records;
<br />THENCE leaving Thorp Lane and crossing the Zunker Tract No. 3 with
<br />the Northeast line of the Southwest Texas State University tract N.
<br />44° 15' 00" W. 810.58 feet to an iron rod for the West corner of this
<br />tract for the North corner of the Southwest Texas State University
<br />tract, in the Northwest line of the Zunker Tract No. 3 and in the
<br />Southeast line.of that 47.84 acre tract of land described in a Deed
<br />from E. J. Hofheinz to the State of Texas dated November 20, 1923,
<br />and recorded in Volume 92, Page 337 of the Hays County Deed Records;
<br />THENCE leaving the Southwest Texas State University tract with the
<br />common line of the State of Texas tract and the Zunker tract N. 43°
