<br /> 102 <br /> ORDINANCE 1984-27 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING DIVISION 2, <br /> ENTITLED "TEXAS MUNICIPAL RETIREMENT SYSTEM" <br /> OF CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID <br /> CITY TO ALLOW CERTAIN EMPLOYEES OF SAID CITY <br /> ~ <br /> WHO HAVE PERFORMED ACTIVE SERVICE IN THE ARMED - <br /> FORCES OF THE UNITED STATES (OR ITS -S:> <br /> 0<::> <br /> AUXILIARIES) OR IN THE ARMED FORCES RESERVE OF + <br /> THE UNITED STATES (OR ITS AUXILIARIES) DURING <br /> PERIODS OF ORGANIZED CONFLICT WITH FOREIGN <br /> FORCES AND WHOSE RELEASES FROM ACTIVE DUTY <br /> WERE MADE ON TERMS OTHER THAN DISHONORABLE, TO <br /> APPLY AND MAKE DEPOSITS FOR, AND TO RECEIVE <br /> SPECIAL CREDIT WITH THE TEXAS MUNICIPAL <br /> RETIREMENT SYSTEM FOR PORTIONS OF SUCH <br /> MILITARY SERVICE AND TO PROVIDE FOR PAYMENT BY <br /> SAID CITY OF ADDITIONAL DEPOSITS TO THE SYSTEM <br /> ON ACCOUNT OF'. SUCH SERVICE CREDI'r AND <br /> DECLARING AN EMERGBNC~. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Division 2 of Chapter 2 of the Code of <br /> Ordinances, City of San Marcos, Texas, is hereby amended by <br /> adding a section, to be numbered 2-49, which said section <br /> shall read as follows: <br /> Sec. 2-49. Military service credits. <br /> ( a) Eligible members in the employment of the <br /> City of San Marcos shall be allowed to <br /> establish credit in the Texas Municipal <br /> Retirement System for active military <br /> service performed as a member of the armed <br /> forces or armed forces reserve of the <br /> United States or an auxiliary of the armed <br /> forces or armed forces reserve, during a <br /> period in which the United States was <br /> involved in an organized conflict with <br /> foreign forces. <br /> (b) An eligible member as used herein shall be <br /> an employee: <br /> ( 1) who has at least ten (10) years of <br /> creditable service in the Texas <br /> Municipal Retirement System; <br /> ( 2) who has been an employee of one or <br /> more participating municipalities <br /> for at least ten (10) years; <br /> ( 3) whose military service was <br /> terminated by release from active <br /> duty or discharge, on terms not <br /> dishonorable; <br /> ( 4) who does not receive and lS not <br /> and will not be eligible to <br /> receive federal retirement <br /> payments based on twenty (20) <br /> years or more of active military <br /> duty or its equivalent; and <br />
