<br /> - AN ORDINANCE OF THE CITY COUNCIL OF THE
<br /> CITY OF SAN MARCOS, TEXAS, ABANDONING
<br /> VACATING A PORTION OF CARSON STREET IN
<br /> Z. WILLIAHSON THIRD ADDITION TO THE CITY
<br /> OF SAN MARCOS, TEXAS; AUTHORIZING THE
<br /> OF SAID CITY TO EXECUTE SPECIAL WARRANTY
<br /> DEEDS; REFLECTING PAYMENT OF THE FAIR
<br /> VALUE OF $1,200.00; PROVIDING FOR THE
<br /> SION OF FEE Icl SAID LAND AND DECLARING
<br /> EFFECTIVE DATE.
<br /> WHEREAS, a portion of Carson Street in the Z. William-
<br /> son Third Addition to the City of San Marcos, the plat
<br /> of said subdivision recorded in Volume 59, Page 545,
<br /> Hays County Deed Records, said portion of said street
<br /> located between Allen, Franklin and North Bishop Streets,
<br /> and being that portion which abuts lots 103 and 165
<br /> as shown on said plat and the most easterly corner of that
<br /> 232.1 acre tract of land, consisting of l4ù.l acres out
<br /> of the J. Williams Survey, SO.U acres out of the R.H.
<br /> Williams Survey, and 42.0 acres out of the T.J. Chambers
<br /> Survey, conveyed to Milton Daniel Buie Properties Part-
<br /> ner$hip, a general partnership consisting of Milton
<br /> Daniel Buie, Dorys Eleanor Boggus Buie and David Hilton
<br /> Buie, general partners, by deed dated June 29, 1983,
<br /> and recorded in Volume 399, Page 326, Deed Records of
<br /> Hays County, Texas; were and are dedicated to public
<br /> use on the plat of the Z. Williamson Third Addition to
<br /> the City of San Harcos of record in Volume 59, Page
<br /> 545 of the Deed Records of Hays County, Texa s; and,
<br /> WHEREAS, the City of San Harcos has been requested
<br /> by Dorys E. Buie, Milton D. Buie, David M. Buie and
<br /> Reuben Meeks to abandon said portion of said street; and,
<br /> WhEREAS, tile City of San Marcos has duly determined
<br /> that Milton Daniel Buie Properties, a general partnership
<br /> of hays County, Texas consisting of Hilton Daniel Buie,
<br /> Dorys Eleanor Boggus Buie and David Hilton Buie, general
<br /> partners, and Reuben H. Heeks and Harian Nelson Meeks
<br /> are the sole owners of all property abutting said por-
<br /> tion of said street; and,
<br /> WHEREAS, the City ~ouncil of the City of San Marcos,
<br /> Texas, has determined that it is in the public interest
<br /> to abandon said portion of said street; and,
<br /> WhEREAS, all of said owners of all land abutting
<br /> saia portion of said street have executed releases, dis-
<br /> charging said City from any damages occasioned by said
<br /> vacation and abandonment; and,
<br /> WHEREAS, the City of San Marcos has determined by
<br /> appraisal that the fair market value of said property is
<br /> $1,200.00 and the same has previously been deposited
<br /> with said City; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br /> SAN ìvlARCOS, TEXAS:
<br /> SECTION 1. That a portion of Carson Street in the
<br /> z. Williamson Third Addition to the City of San Harcos,
<br /> the plat of said subdivision recorded in Volume 59, Page
<br /> 545, Deed Records of Hays County, Texas, said portion of
<br /> saiu street being located between Allen, Franklin and North
<br /> Bishop Streets, and being that portion which abuts lots
