<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND
<br /> CONDITIONS OF THE SALE BY THE CITY OF SAN
<br /> MARCOS, TEXAS, OF PART OF FARM LOT ELEVEN
<br /> (11), OUT OF THE J.M. VERAMENDI LEAGUE NO.
<br /> ONE (1) IN HAYS COUNTY, TEXAS TO LEE SWIFT;
<br /> AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY
<br /> DEED TO LEE SWIFT AND DECLARING AN EMERGENCY.
<br /> WHEREAS, the City of San Marcos, Texas, advertised for
<br />bids for the sale of part of Farm Lot Eleven (11) out of the
<br />J.M. Veramendi League No. One ( 1) in Hays County, Texas
<br />also known as Urban Renewal Parcels Nos. 23A-5A, 5B, and 5C,
<br />in the San Marcos Record, a local newspaper with a general
<br />circulation in the County of Hays, State of Texas, on
<br />September 11, 1983 and September 13, 1983; and
<br /> WHEREAS, pursuant to said advertisement a bid was
<br />submitted by Lee Swift for said described property in the
<br />amount of twelve thousand dollars ($12,000.00); and,
<br /> WHEREAS, said bid met the minimum disposition price set
<br />for said property by the Urban Renewal Board of Commissioners
<br />of the City of San Marcos, Texas on June 1, 1982; and,
<br /> WHEREAS, said Board accepted the bid as the highest and
<br />best responsible bid for said property on March 7, 1984; and,
<br /> WHEREAS, said Board recommends the approval of said
<br />purchase price and the approval of the terms and conditions
<br />for said sale, as contained in the bid document; now,
<br />therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br /> SECTION 1. That the terms and conditions of the sale by
<br />the City of San Marcos, Texas, of part of Farm Lot El even
<br />(11) out of the J.M. Veramendi League No. One (1) in Hays
<br />County, Texas, which said portion of said Farm Lot is more
<br />particularly described by metes and bounds as follows,
<br />to-wit:
<br /> TRACT A:
<br /> 10,656 square feet of land, a part of Farm Lot
<br /> No. 11, out of the J.M. Veramendi League No. One
<br /> ( 1), in Hays County, Texas described by metes and
<br /> bounds as follows, to-wit:
<br /> BEGINNING, at an iron stake on the northeast line
<br /> of Mitchell Avenue as of record in Volume 46,
<br /> Page 448 of the Hays County Deed Records and at
<br /> the most southern corner of a tract of land
<br /> conveyed by I.B. Strader, Jr., et. al., to Marvin
<br /> Merriweather by deed of date March 18, 1946, and
<br /> of record in Volume 134, Page 226 of the Hays
<br /> County Deed Records, and the most western corner
<br /> of a tract of land conveyed by S.B. Barber,
<br /> Administrator, to George Smith by deed of date of
<br /> February 3, 1942, and of record in Volume 129,
<br /> Pages 113-116 of the Hays County Deed Records,
<br /> and a one-half undivided interest of the
<br /> identical tract of land was conveyed by George
<br /> Smith to James Smith by deed of date February 6,
<br /> 1942, and of record in Volume 129, Pages 112-113,
<br /> of the Hays County Deed Records,
