<br /> 45 <br /> ORDINANCE 1984-46 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, DECLARING A SIXTY-FIVE <br /> (65) DAY BUILDING MORATORIUM FOR MULTI-FAMILY <br /> DWELLINGS IN THE PLANNING UNITS 1, 2, 3, 4, 1 <br /> AND 17, DECLARING A SIXTY-FIVE (65) DAY <br /> BUILDING MORATORIUM ON ALL MULTI-FAMILY <br /> OF TWENTY UNITS OR MORE, LIMITING BUILDING <br /> FOR MULTI-FAMILY CONSTRUCTION, DECLARING A S <br /> FIVE (65) DAY BUILDING MORATORIUM ON ALL <br /> OF LAND NOT ZONED IN CONFORMANCE WITH THE CI <br /> MASTER PLAN, PROVIDING FOR THE REVOCATION OF <br /> TAIN BUILDING PERMITS, SUSPENDING THE BUILDING <br /> AND SITE DEVELOPMENT PERMIT PROCESS, DIRECTING <br /> THE CITY MANAGER TO PREPARE A REPORT BY JUNE 4, <br /> 1984, REGULATING DENSITY OF RESIDENTIAL CONSTRUC- <br /> TION, DECLARING AN EMERGENCY AND PROVIDING FOR <br /> AN EFFECTIVE DATE. <br /> , the City Council of the City of San Marcos has <br /> that wastewater capacity in the Chestnut/No L.B.J./ <br /> a is becoming overloaded because of the level of <br /> t in the area and drainage infiltration of the main <br /> ; and, <br /> WHEREAS, the City Council of the City of San Marcos has <br /> determined that traffic congestion is excessive in the Chest- <br /> nut/No L.B.J./Sessom area; and, <br /> WHEREAS, the City Council of the City of San Marcos has <br /> determined that water pressures in certain parts of the Chest- <br /> nut/No L.B.J./Sessom area are inadequate; and, <br /> WHEREAS, the City Council of the City of San Marcos has <br /> determined that it is necessary to maintain the status quo in <br /> the Chestnut/No L.B.J./Sessom area while additional information <br /> lS secured by staff for consideration by Council concerning <br /> the above-mentioned problems in the Chestnut/No L.B.J./Sessom <br /> area; and, <br /> WHEREAS, the City Council of the City of San Marcos has <br /> determined that the level of recent growth in the City necessitates <br /> more rapid implementation of the City of San Marcos Master Plan; <br /> and, <br /> WHEREAS, the City Council of the City of San Marcos has <br /> found that numerous parcels of land throughout the City are <br /> presently zoned out of compliance with the Master Plan Land <br /> Use Element; and, <br /> WHEREAS, the City Council of the City of San Marcos find <br /> that it is necessary to preserve the status quo to prevent <br /> further development in the City that is not in compliance with <br /> the Master Plan until such time as more progress has been made <br /> to further implement the Master Plan; and, <br /> WHEREAS, the City Council of the City of San Marcos has <br /> determined that rapid growth in the City, particularly in <br /> multi-family development, has made it necessary to review the <br /> adequacy of the Land Use Element of the City's Master Plan; <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That for a period of sixty-five (65) days <br /> from the effective date hereof no building permits for other <br /> than single-family detached residential construction be issued <br /> in Planning Units 1, 2, 3, 4, 10, and 17 as they are designated <br /> in the City's Master Plan, except that commercial building ln <br /> Planning Unit 17 shall be exempt from the requirements of this <br />
