<br /> Ordinance and any rehabilitation, remodeling, or construction <br /> builqouts under existing building shells shall be permitted in <br /> each of the Planning Units designated above. <br /> SECTION 2. That for a period for sixty-five (65) days <br /> from the effective date hereof, no building permits for multi- <br /> fami¡y residential construction projects of twenty (20) <br /> units or more be granted for such construction anywhere with- <br /> in the city limits of the City of San Marcos. No builder, <br /> developer, construction company or any similar entity or anyone <br /> work:i.ng in consort with such an entity may receive a building <br /> permit or pe~~its for more than twenty (20) units of multi- <br /> family residential construction during this sixty-five (65) <br /> day moratorium. <br /> SECTION 3. That for a period of sixty-five (65) days <br /> from the effective date hereof, no building permits be issued <br /> for any type of construction on any parcel of land within the <br /> City of San Marcos that is zoned for a use not in compliance <br /> with the land use scheme of the Master Plan of the City of <br /> San Marcos, Ordinance 1983-22, which was passed, approved <br /> and adopted on May 9, 1983. <br /> SECTION 4. That during the sixty-five (65) day periods <br /> of building permit moratoria prescribed in this Ordinance, all <br /> time limits pertaining to the said building permit process and the <br /> site development permit process, be, and they are hereby, suspended, <br /> and no further processing of building permits and site development <br /> permits, shall be done by staff during the prescribed moratoria <br /> periods, except for those building or site develoI?!!.l~E:~:eermi!: <br /> ~pplications that were on file on the effective date of this <br /> Ordinance. For those permit applications on file on the effective <br /> date of this Ordinance, the period for site development permit. <br /> review is extended from twenty (20) days to forty (40) days. <br /> SECTION 5. rhat during the sixty-five (65) day periods <br /> of building permit moratoria prescribed in this Ordinance, the <br /> City Manager shall prepare a detailed report of the matters <br /> raised in this Ordinance and its preamble and submit such re- <br /> port to the City Council no later than June 4, 1984. <br /> SECTION 6. That any building permit, site development permit, <br /> or demolition permit issued prior to the effective date of this <br /> Ordinance, pertaining to the areas or restrictions enumerated in <br /> Sections 1, 2 or 3 of this Ordinance, is hereby revoked, and any <br /> monies paid for and under said permit are ordered returned to <br /> the permittee without unreasonable delay, provided that no material <br /> or substantial amount of construction has commenced under said <br /> permit as of the effective date of this Ordinance. The phrase <br /> "material or substantial amount of construction" shall include <br /> !~e completion of all that work necessary to be completed before <br /> the first general inspection can be performed. <br /> SECTION 7. During the moratoria prescribed herein, no <br /> residential construction in excess of fifteen (15) units per <br /> acre shall be permitted in the City. <br /> SECTION 8. That the importance of this Ordinance creates <br /> an emergency and an imperative public necessity so that the <br /> provisions of the charter requiring all ordinances to be read <br /> at three separate meetings and that no ordinance shall become <br /> effective until the expiration of ten (10) days following the <br /> date of its final passage, be suspended, and this Ordinance <br /> shall take effect and be in full force and effect from and <br /> after its adoption and it shall be published in a newspaper <br /> of general circulation within the City in accordance with <br /> the charter of the City of San Marcos. <br /> PASSED, APPROVED AND April , 1984. <br />
