<br /> 77 <br /> STATE OF TEXAS § <br /> COUNTY OF HAYS § <br /> CITY OF SAN MARCOS, TEXAS <br /> PERFORMANCE CONTRACT FOR PROFESSIONAL SERVICES <br /> This contract and agreement is made and entered into by and <br /> between the City of San Marcos, hereinafter referred to as "C i ty " , <br /> and the Law Office of Charles W. Chapman, Attorney at Law, herein- <br /> after referred to as "Contractor". The parties hereto ha ve <br /> severally and collectively agreed and by the execution hereof <br /> are bound to the mutual obligations and to the performance and <br /> accomplishment of the tasks hereinafter described. <br /> Contractor shall perform the following activities: <br /> 1. provide legal advice and opinions to the Airport Commission <br /> of the City on ~1 un i c i pal Airport legë:.l matters, which advice <br /> and opinions s ha 11 not include representation of the Airport <br /> Commission, individual Airport Commission commissioners, or <br /> the City in litigation related to or directly concerned with <br /> the City's Municipal Airport unless ét gree d to by Contractor <br /> under a separate contract and agreement entered into by <br /> Contractor with the City of San Marcos. <br /> 2. prepare and review leases and contracts pertaining to the <br /> City's Municipal Airport; <br /> 3. conduct legal research and provide written memoranda based <br /> on such research to the Airport Commission on legal questions <br /> or issues related to the operation, management, and functions <br /> of the Municipal Airport; and <br /> 4. prepare and review ordinances pertaining to the City's Municipal <br /> Airport. <br /> Charles W. Chapman of the Law Office of Charles W. Chapman, referred <br /> to 1 n this contract as "Contractor", is a 1 icensed attorney, licensed to <br /> practice law in the courts of the State of Texas, and is possessed of <br /> the requisite and professional knowledge to provide the services required <br /> and agrees to exert his best efforts and professional skills for the <br /> benefit 0 f a'-n d use by the City. It is expressly understood and agreed <br /> by the parties to this contract that neither Mr. Chapman nor any <br /> associate attorney or employee of the Law Office of Charles W. Chapman <br /> is an employee of the City. City further understands that Contractor <br /> is an Assistant Professor vJÌth Southwest Texas State University with <br /> Pa ge 1 of 3 pages <br />
