<br /> teaching responsibilities and obligations under a contract of employ- <br /> ment with such University and City agrees that Contractor1s services <br /> to City under this contract shall be rendered at such times as will <br /> not conflict with Contractor's said teaching responsibilities and <br /> obligations. Contractor agrees that the activities to be performed <br /> by Contractor for the City under this contract and agreement s ha 11 be <br /> performed at times other than those se t aside by the City Attorney <br /> for Contractor to perform activities required of Contractor under a <br /> separate and independent contract and agreement with the City entered <br /> into by Contractor and City on September 26, 1983. <br /> The term of this contract and agreement shall commence on the <br /> da te of mutual execution of this contract and agreement by the parties <br /> hereto. This contract and agreement s ha 11 terminate one year from the <br /> da te of such execution, except that either party hereto may terminate <br /> this contract and agreement with written notice to the other party. <br /> The City shall pay to Contractor, a san attorney's fee, a sum <br /> equal to fifty dollars ($50.00) for each hour of time expended by the <br /> Contractor in the performance of the activities listed hereinabove for <br /> City. To receive such fee, Contractor shall submit to the Airport <br /> Manager or to the supervisor of the Airport Manager, in the absence of <br /> the Airport Manager, every two (2) weeks, a statement of services <br /> rendered by Contractor during such two (2) weeks period of time. The <br /> first such statement s hall -be submitted by Contractor on the Friday <br /> of the second week following the execution of this contract and agreement <br /> by the parties, and shall be submitted by Contractor on the Friday of <br /> every second week thereafter through the termination of this contract <br /> and agreement. Such statement s ha '11 itemize the activities performed <br /> by the Contractor and the work accomplished within such activities by <br /> the Contractor. Such statement shall further indicate numerically the <br /> amount of time expended by Contractor on each separate itemized activity <br /> and on each separate work item within the activities. The statement <br /> shall indicate the amount of attorney's fee due and payable from the <br /> City to Contractor for the legal services rendered by the Contractor <br /> to the City for the particular two (2) \'iee k s period of time pertinent <br /> to such statement. The City shall, no later than the Friday of the <br /> week follovling the receipt of such statement by the Airport Manager or <br /> the supervisor, in the absence of the Airport Manager, pay to Contractor <br /> the amount of attorney's fee indicated in such statement, except in <br /> the event City has a reasonable and legitimate dispute as to either an <br /> amount of time listed on such statement as having been expended by <br /> Contractor or as to an item of activity or work listed on such statement <br /> by Contractor as having been performed by Contractor during the pertinent <br /> two (2) weeks period addressed by s uc h statement. In the event of s uc h <br /> a dispute by City, City shall subtract from the amount to be paid <br /> Contractor for the pertinent two (2) we e k s period under the procedure <br /> described hereinabove and shall not be obligated to pay Contractor for <br /> such disputed time or item until such dispute ha s been resolved by the <br /> parties hereto, if s uc h dispute i s resolved in the favor of Contractor. <br /> The City shall, ho\'iever, pay the Contractor the remaining amount owed <br /> to Contractor under the procedure hereinabove provided, after the <br /> subtraction of the amount indicated by the Contractor in such statement <br /> as being due and payable for the said disputed time or item. <br /> Pa ge 2 of 3 pages <br />
