<br /> 79 <br /> LEASE AND OPERATING AGREEMENT <br /> This Lease and Operating Agreement (the "Agreement") entered into <br /> as of -~1-_-----------, 1984, by and between the City of San <br /> Marcos, Texas, a municipal corporation existing by and under the laws <br /> of the ,8 ta te of Texas, acting through authority conferred on its <br /> Gayor, Emmie Craddock, by resolution duly adopted on <br /> May 7 , 1984, (hereinafter "Lessor") and NORTH AMERICAN <br /> <br /> AEROSPACE CORPORATION, (NAAC) (hereinafter "Lessee"), agree on the <br /> following terms and conditions: <br /> ARTICLE I. <br /> LEASED PREMISES <br /> Lessor hereby leases to Lessee the following premises, identified and <br /> shown in Exhibit A hereto ("The Premises"), together with the right of <br /> ingress and egress for both vehicles and aircraft: <br /> A. Real Property as follows: An area shown in Exhibit A which is <br /> approximately 64,862 square feet, starting 6 feet East of the East <br /> ~ide of one hangar pad which is 80 feet wide and located approximately <br /> 55 feet from the East most property line of the ~urrent city airport <br /> property. Then the leased property will extend 287 feet East along the <br /> ramp and then approximately 226 feet South to the South most property <br /> line located at the most Southeast corner of the city property. This <br /> area includes the existing control tower as shown in Exhibit A. Lessee <br /> may for a period of five years from the date of this agreement a-dd to <br /> the leased area that property which is shown in Exhibit A as the <br /> shaded area. This includes one par.Ç.el East of the leased property of <br /> approximately .322 acres and one parcel South of the leased property <br /> of approximately .544 acres. The same terms and conditions will apply <br /> to this area as to the original area. However, in the event that <br /> another company or individual may wish to lease this property prior to <br /> ~AC adding it to its main lease then NAAC must exercise its rights to <br /> PAGE 1 <br />
