<br /> 81 <br /> THE STATE OF TEXAS X <br /> X <br /> COUNTY OF CALDWELL X <br /> LEASE <br /> KNOW ALL PERSONS BY THESE PRESENTS: <br /> WHEREAS, the City of San Marcos, Texas is the owner of the <br /> San Marcos Municipal Airport, situated in Caldwell County, Texas, <br /> hereinafter "Airport," by virtue of an indenture from the United <br /> States of America dated the 24th day of February, 1966, and the <br /> 14th day of July, 1969, and the 11th day of May, 1976, to which <br /> reference is hereby made; and <br /> WHEREAS, Robert N. Ingram, whose local address is at Route 2, <br /> Box 331, San Marcos, Texas, 78666, a private citizen, operating <br /> an aircraft out of the San Marcos Municipal Airport?desires to ob- <br /> tain from the City of San Marcos a land lease upon which to con- <br /> struct a storage facility for his aircraft; and <br /> WHEREAS, the City of San Marcos, as Lessor, in order to ef- <br /> fectuate use of the subject premises to construct such storage <br /> facility desires to enter into a lease of a portion of such air- <br /> port with Robert N. Ingram, as Lessee, and Robert N. Ingram does <br /> desire to lease such property for the construction of a storage <br /> facility for his aircraft in accordance with the following terms <br /> and conditions: <br /> WITNESSETH: <br /> 1. Demised Premises. <br /> The City of San Marcos, hereinafter called Lessor, hereby <br /> leases to Robert N. Ingram, hereinafter called Lessee, and <br /> said Lessee rents from Lessor that certain premises con- <br /> taining 2400 square feet, more or less, described and iden- <br /> tified in Exhibit A attached hereto and incorporated by <br /> reference herein. <br /> 2. Survey':' <br /> Lessee agrees to cause an exact survey made of said premises, <br /> at Lessee's expense, and both parties agree that this sur- <br /> vey will be made a part of this Agreement. <br /> 3. Term of Lease. <br /> ------.---- <br /> The term of this lease for the property heretofore described <br /> in paragraph 1 shall be for a term of twenty (20) years be- <br /> ginning the ~--- day of ----- May_____---, 198 4 and running <br /> through the 8 day of -- May_____--- , -2'00 4 . <br /> -- --.-- <br /> 4. Consideration. <br /> As consideration and rental for the demised premises, Lessee <br /> agrees to pay to Lessor the sum of nine cents ($.09) per <br /> square foot per year, payment to be made in advance and on each <br /> anniversary date of this lease. However, Lessee shall receive <br /> a credit of three cents ($.03) per annum per square foot against <br /> said annual rental rate in consideration of Lessee constructing <br /> (or overlaying) a taxi-way along the Southwest end of the leased <br /> premises as provided in Paragraphs 6 and 7 of this Agreement. <br />
