81 THE STATE OF TEXAS X X COUNTY OF CALDWELL X LEASE KNOW ALL PERSONS BY THESE PRESENTS: WHEREAS, the City of San Marcos, Texas is the owner of the San Marcos Municipal Airport, situated in Caldwell County, Texas, hereinafter "Airport," by virtue of an indenture from the United States of America dated the 24th day of February, 1966, and the 14th day of July, 1969, and the 11th day of May, 1976, to which reference is hereby made; and WHEREAS, Robert N. Ingram, whose local address is at Route 2, Box 331, San Marcos, Texas, 78666, a private citizen, operating an aircraft out of the San Marcos Municipal Airport?desires to ob- tain from the City of San Marcos a land lease upon which to con- struct a storage facility for his aircraft; and WHEREAS, the City of San Marcos, as Lessor, in order to ef- fectuate use of the subject premises to construct such storage facility desires to enter into a lease of a portion of such air- port with Robert N. Ingram, as Lessee, and Robert N. Ingram does desire to lease such property for the construction of a storage facility for his aircraft in accordance with the following terms and conditions: WITNESSETH: 1. Demised Premises. The City of San Marcos, hereinafter called Lessor, hereby leases to Robert N. Ingram, hereinafter called Lessee, and said Lessee rents from Lessor that certain premises con- taining 2400 square feet, more or less, described and iden- tified in Exhibit A attached hereto and incorporated by reference herein. 2. Survey':' Lessee agrees to cause an exact survey made of said premises, at Lessee's expense, and both parties agree that this sur- vey will be made a part of this Agreement. 3. Term of Lease. ------.---- The term of this lease for the property heretofore described in paragraph 1 shall be for a term of twenty (20) years be- ginning the ~--- day of ----- May_____---, 198 4 and running through the 8 day of -- May_____--- , -2'00 4 . -- --.-- 4. Consideration. As consideration and rental for the demised premises, Lessee agrees to pay to Lessor the sum of nine cents ($.09) per square foot per year, payment to be made in advance and on each anniversary date of this lease. However, Lessee shall receive a credit of three cents ($.03) per annum per square foot against said annual rental rate in consideration of Lessee constructing (or overlaying) a taxi-way along the Southwest end of the leased premises as provided in Paragraphs 6 and 7 of this Agreement.
