<br /> - 4 - <br /> If the Lessor shall be in default in performing any of the <br /> terms or provisions of this lease required on its part to <br /> be performed, and Lessee shall give Lessor notice in writing of <br /> such default, and if the Lessor shall fail to cure such de- <br /> fault within thirty (30) days after service of such notice, <br /> then and in such event, this lease shall be terminated and <br /> cancelled. <br /> 12. Operation of the Airport. <br /> (1) Lessor reserves the right to operate the airport in <br /> accordance with the obligation to the Federal or State <br /> Government under any of the agreements for which aid for <br /> development was granted; provided, however, if such opera- <br /> tion restricts the operation of Lessee on the demised premi- <br /> ses, appropriate rental reductions shall be negotiated. In <br /> the event that appropriate rental reductions cannot be nego- <br /> tiated between the parties hereto, then in such event, this <br /> lease shall terminate and the parties hereto shall have no <br /> further obligations hereunder. <br /> (2) It is specifically understood and agreed that nothing <br /> contained herein shall be construed as a granting or auth- <br /> orizing the granting of an exclusive right for exercising of <br /> an aeronautical activity, nor to conduct any activity which <br /> is discriminatory, and Lessee specifically agrees to operate <br /> a non-discriminatory operation. Lessee, his agents and em- <br /> ployees, will not discriminate in any manner prohibited by <br /> Federal Aviation Regulations. Lessee further agrees to <br /> comply with such enforcement procedures as might be re- <br /> quired by the United States of America. <br /> (3) Lessor reserves the right to take any action it considers <br /> necessary to protect the aerial approaches of the airport <br /> against obstructions; and additionally, to limit the Lessee <br /> from erecting or permitting to be erected any building or <br /> structure on the airport and on the demised premises that <br /> would limit the usefulness of the airport or that would con- <br /> stitute a hazard to aircraft. <br /> (4) Lessor reserves the right to further develop the air- <br /> port as it sees fit regardless of the desires of the Lessee, <br /> and without any hindrance or interference from such Lessee. <br /> Lessor expressly reserves the right to grant to others addi- <br /> tional leases and privileges with respect to said airport <br /> facility even though the purposes for which such additional <br /> leases are given are the same and duplicates those contained <br /> in this lease. If the development of the airport requires <br /> the relocation of Lessee-owned facilities, the Lessor agrees <br /> to provide a location comparable to that provided to other <br /> private Lessees at the time of the relocation without any <br /> unreasonable interruption to the Lessee's activities, and <br /> agrees to relocate all Lessee-owned buildings, or provide <br /> similar facilities for the Lessee at no cost to the Lessee, <br /> except that Lessor shall not be required to pay more than the <br /> wholesale cost of foundation materials. <br /> (5) This lease shall subordinate to provisions of any <br /> existing or future agreement entered into by and between <br /> Lessor and the Federal or State Governmeht for the improvement, <br /> operation and maintenance of the airport; provided that if such <br /> agreement restricts the operation of the demised premises, <br /> appropriate rental reductions shall be negotiated. In the <br /> event that such appropriate rental reductions cannot be nego- <br /> tiated, then this lease shall terminate and the parties hereto <br /> shall have no further obligations hereunder. <br />
