- 5 - (6) The use of the subject premises by Lessee shall be restricted to those connected with aviation purposes or aviation related purposes, except for uses expressly ex- cluded hereby. (7) All permanent improvements on demised property placed upon the premises by Lessee during the term of such lease shall revert to Lessor on termination of the lease; pro- vided, however, that Lessee, having paid all rentals and not in default thereof, shall be given a reasonable time, not to exceed thirty (30) days after the termination of this lease, to remove all of Lessee's personal property. (8) Maintenance of the runways, taxi-ways, entrance roads, driveways, existing parking lots, leading to and/or contigu- ous to the demised property, and unoccupied property of the San Marcos Municipal Airport, except for the premises demised and leased by Lessee including the overlay of the taxi-way provided for herein in Paragraph 6,shall remain the obliga- tion of the Lessor; provided, however, that Lessor shall only be obligated to use airport revenue funds for such purposes and it shall never have the obligation to use general, opera- ting or bond funds for this purpose. (9) Lessee shall be responsible for all maintenance, repairs, and upkeep of the ground and utilities upon the demised premi- ses and hereby agrees to keep said premises in a sightly condi- tion. All utility bills for which the City becomes liable on the demised property shall be paid by Lessee on the demised property. (10) Lessee shall not assign or sublease this lease without first obtaining the prior written approval of the Lessor, which approval shall not be unreasonably withheld, and fur- ther provided that no sublease or assignment of lease shall ever be given except for the purposes and uses authorized hereby. (11) The Lessee's enjoyment of this lease upon and about the airport facility and upon the demised premises shall be sub- ject and in conformance with all State, Federal and City ordi- nances and regulations. (12) Lessor shall not be responsible or liable at any time for any loss to or damage of Lessee's merchandise, equipment, fixtures, machinery, airplanes or airplane parts or any other personal property of Lessee at Airport.
