<br /> - 5 - <br /> (6) The use of the subject premises by Lessee shall be <br /> restricted to those connected with aviation purposes or <br /> aviation related purposes, except for uses expressly ex- <br /> cluded hereby. <br /> (7) All permanent improvements on demised property placed <br /> upon the premises by Lessee during the term of such lease <br /> shall revert to Lessor on termination of the lease; pro- <br /> vided, however, that Lessee, having paid all rentals and not <br /> in default thereof, shall be given a reasonable time, not <br /> to exceed thirty (30) days after the termination of this lease, <br /> to remove all of Lessee's personal property. <br /> (8) Maintenance of the runways, taxi-ways, entrance roads, <br /> driveways, existing parking lots, leading to and/or contigu- <br /> ous to the demised property, and unoccupied property of the <br /> San Marcos Municipal Airport, except for the premises demised <br /> and leased by Lessee including the overlay of the taxi-way <br /> provided for herein in Paragraph 6,shall remain the obliga- <br /> tion of the Lessor; provided, however, that Lessor shall only <br /> be obligated to use airport revenue funds for such purposes <br /> and it shall never have the obligation to use general, opera- <br /> ting or bond funds for this purpose. <br /> (9) Lessee shall be responsible for all maintenance, repairs, <br /> and upkeep of the ground and utilities upon the demised premi- <br /> ses and hereby agrees to keep said premises in a sightly condi- <br /> tion. All utility bills for which the City becomes liable on <br /> the demised property shall be paid by Lessee on the demised <br /> property. <br /> (10) Lessee shall not assign or sublease this lease without <br /> first obtaining the prior written approval of the Lessor, <br /> which approval shall not be unreasonably withheld, and fur- <br /> ther provided that no sublease or assignment of lease shall <br /> ever be given except for the purposes and uses authorized <br /> hereby. <br /> (11) The Lessee's enjoyment of this lease upon and about the <br /> airport facility and upon the demised premises shall be sub- <br /> ject and in conformance with all State, Federal and City ordi- <br /> nances and regulations. <br /> (12) Lessor shall not be responsible or liable at any time <br /> for any loss to or damage of Lessee's merchandise, equipment, <br /> fixtures, machinery, airplanes or airplane parts or any other <br /> personal property of Lessee at Airport. <br /> THIS LEASE EXECUTED IN DUPLICATE ORIGINALS this the 8 <br /> day of 1984. - <br /> May , <br /> LESSOR <br /> CITY OF SAN MARCOS <br /> /" <br /> C/ <br /> By: ;/~~. <br /> - <br /> Emmie Craddock, Mayor <br /> Attest: <br />
