<br /> EXHIBIT B <br /> T-BANGAR LEASE AGREEMENT <br /> ("Tenant") and the City of San Marcos <br /> ("Owner") agree as follows: <br /> 1. Subject to the terms hereof, Owner shall permit tenant <br /> to store an aircraft in T-hangar No. (hereinafter called <br /> the T-hangar") at the San Marcos Municipal Airport (hereinafter <br /> called "Airport"). Except as provided in Paragraph 5 and else- <br /> where herein, the term of this agreement and the rentals due <br /> hereunder shall continue until such time as one party gives the <br /> other written notice of termination, as herein provided. Either <br /> party may, upon fifteen (15) days written notice to the other, <br /> terminate this agreement at any time, such termination to be <br /> effective at the time set -forth in such notice. All notices here- <br /> under -to the OWner shall be in writing and shall be addressed and <br /> mailed as follows: <br /> Airport Manager <br /> 630 E. Hopkins <br /> San Marcos, Texas 78666 <br /> All notices to the Tenant shall be in writing and shall be mailed <br /> to the Tenant at the address indicated below. If any such notice <br /> to the Tenant shall be returned by the United States Postal Office <br /> Department, notice shall be given by posting the same to the <br /> Tenant's T-hangar door. <br /> 2. Tenant shall pay to the Owner as rental for the right <br /> to use the T-hangar as herein set forth the sum of , <br /> per month as established by the City Council. All rental fees <br /> are payable in advance on the first of each and every month <br /> during the term hereof. If the initial term commences on other <br /> than the first day of the month, the first month's rent shall be <br /> pro-rated on a daily basis and shall be due and payable immediately <br /> upon execution of this lease agreement. If payment has not been <br /> received by Owner at the address indicated in Paragraph 1 by the <br /> tenth day of each month, a five dollar ($5.00) late fee will be <br /> assessed in addition to said monthly rental. Tenant shall be <br /> deemed to be in default under this lease if each such rent plus <br /> applicable late fee and additional charges provided for herein <br /> have not been received by OWner at the address indicated in Para- <br /> graph 1 by the twentieth day of each such month. Owner agrees <br /> to notify tenant in writing at least thirty days in advance of <br /> any changes in the monthly rental fee. An amount equal to one <br /> month's rent is required to be paid to Owner as a security deposit <br /> on or before the effective date of this lease. <br /> 3. Tenant herein cóvenants and agrees that he will protect <br /> the rights, safety, and property of other tenants by a strict <br /> adherence to the San Marcos Municipal Airport's Rules and Regula- <br /> tions as well as those ordinances pertaining to the airport con- <br /> tained in the Code of Ordinances/City of San Marcos, as they now <br /> exist and as they may be later amended. Copies of such rules and <br /> regulations and ordinances are located in the office of the Airport <br /> Manager and are available to the Tenant at any time during normal <br /> working hours. Tenant further agrees to abide by all rules and <br /> regulations of the Federal Aviation Administration, State of Texas, <br /> and all other duly constituted public authorities having jurisdic- <br /> tion. <br /> 4. Tenant covenants that he has examined the leasehold <br /> premises prior to, and as a condition precedent to, the execution <br /> of this lease and is satisfied with the physical condition of said <br /> premises and warrants that the leasehold premises are in a safe, <br /> sanitary and sightly condition and are in good repair. <br />
