" <br /> <br />paving resulting from Grantee's use of the Easement within the Permanent <br />Easement Strip shall be at Grantee's sole cost. <br /> <br />5. <br /> <br />Grantor expressly reserves the right to use all or any part of the Permanent <br />Easement Strip for any other or further purpose that does not damage, destroy, <br />injure and/or interfere with the use of the Permanent Easement Strip for the <br />purposes for which the Easement is conveyed. <br /> <br />6. Grantor expressly reserves the right to connect to the sanitary sewerline within <br />the Permanent Easement Strip in accordance with Grantee's then existing <br />requirements for sewer connections to private parties as of the date of each <br />respective connection in order to provide sewer service to Grantor's 52.93 acre <br />tract <br /> <br />7. Grantor expressly reserves the right to extend fences across and along the <br />Permanent Easement Strip herein conveyed. <br /> <br />Grantee Covenants and Agrees as Follows: <br /> <br />1. <br /> <br />Grantee agrees that Grantee's ingress and egress over Grantor's land, is limited to <br />ingress and egress over the Permanent Easement Strip and the Temporary <br />Construction Permanent Easement Strip (until temrination as provided herein) <br />unless Grantee obtains the prior written permission of Grantor. <br /> <br />2. <br /> <br />Grantee agrees that, save and except for manholes and fire hydrants, Grantee shall <br />not construct or maintain any permanent above ground appurtenances within said <br />easement herein conveyed. <br /> <br />3. Grantee agrees to comply at all times and at itS sole cost with all applicable <br />federal, state, and local laws, rules, regulations, and safety standards in <br />connection with Grantee's activities hereunder. <br /> <br />4. Grantee is not and shall not be construed as Grantor's agent in contracting for any <br />improvements to the Permanent Easement Strip and shall have no authority to <br />pledge, mortgage, hypothecate or otherwise encumber any interest in the <br />Permanent Easement Strip, except for Grantee's easement rights hereunder. <br />Grantee shall, to the extent allowed by law, indemnify and hold harmless Grantor <br />from and against any and all mechanic's, materiahnen's or other liens or claims <br />(and all costs and expenses associated therewith) asserted, filed or arising out of <br />any such work. <br /> <br />5. <br /> <br />Gr;mtee shall be required and does hereby agree, after the completion of any <br />construction, installation, repair, maintenance, replacement, or removal within the <br />Permanent Easement Snip, to restore the Permanent Easement Strip and <br />Temporary Construction Permanent Easement Strip with topsoil, and to compact <br /> <br />3 <br />
