It is hereby agreed that upon a finding by the City Council of the unsatisfactory performance by Authority of any of the duties and responsibilities assigned to Authority by this Agreement, City shall have the right to immediately thereafter remove any funds held under the control of Authority and to return said fund s to the sole control of City. Hritten notice shall be given Authority by City of such action at the time of the action or as soon after such action as is practicable. VI. City agrees to utilize the proceeds from the sale of land acquired through the Community Development Entitlement Block Grant Program for the continuation of community development activities and/or programs. A plan for such activities and/or programs shall be developed by Authority and submitted to the City for approval no less than once in each fiscal year of the City during the term of this Agreement. VII. Authority covenants and agrees not to discriminate upon the basis of age, religion, race, sex, national origin or physical handicap in the administration of Community Development activities and/or programs conducted under authority of this Agreement. VIII. Authority shall not assign any of the duties and responsibilities given to it by this Agreement. IX. All services and administrative activities conducted pursuant to the terms of this Agreement shall be conducted on premises maintained by Authority; provided, however, that this section shall not apply to those services provided by City pursuant to Part II. X. The foregoing instrument 1n writing constitutes the entire agreement herein, there being no other written or parole agreement with any officer or employee of the City.
