Gonzalez, City Manager May 15, 1984 City of San Marcos Page 2 ~Js ~contractor takes or soould take; however, the Engineer will exercise diligence in performing his duties to accepted pro- . fessional standards); 3) consult and advise with the Owner; issue all instructions to the contractor requested by the Owner; and prepare and issue routine change orders with Owner's approval; 4) review samples, catalog data, schedules, shop drawings, laboratory, shop and mill tests of material and equipment and other data which the contractor submits (this review is for the benefit of the Owner and covers only general conformance with the information given by the Contract Documents); 5) obtain and review month~ and final estimates for payments to contractors, and furnish to the Owner any recommended payments to contractors and suppliers; assemble written guarantees which are required by the Contract Documents; 6) conduct, in company with the Owner, a final inspection of the Project for compliance with the Contract Documents, and submit recommendations concerning project status, as it may affect Owner's final payment to the contractor. Our compensation for these services will be on our standard cost times multiplier basis in accordance with the Schedule of Charges shown as Attachment A. However, this fee will not exceed the total amount that would have been due using the percent of construction cost method of payment based on the actual construction cost and Curve A as shown on Attachment B. The compensation ceiling for the Design Phase fee will be 85% of the Basic Charge from Attachment B and the ceiling for the General Representation Phase fee will be 15% of the Basic Charge. The estimate of probable construction cost in the Preliminary Engineering Report will be used to establish the fee ceiling until the construction contract 1S awarded. If a construction contract is not awarded within ninety days from completion of final plans and specifications, the fee ceiling will be based on the Engineer's final estimate of probable construction cost or billable hours worked, whichever is less. We will perform any additional services as requested and authorized in writing by the City such as field surveys, construction staking, preparation of easement information, resident representation during construction, etc., on a cost times multiplier basis in accordance with the Schedule of Charges shown as Attachment A.
