Gonzalez, City Manager May 15, 1984 <br /> City of San Marcos Page 2 <br /> ~Js <br /> ~contractor takes or soould take; however, the Engineer will <br /> exercise diligence in performing his duties to accepted pro- <br /> . fessional standards); 3) consult and advise with the Owner; <br /> issue all instructions to the contractor requested by the <br /> Owner; and prepare and issue routine change orders with Owner's <br /> approval; 4) review samples, catalog data, schedules, shop <br /> drawings, laboratory, shop and mill tests of material and <br /> equipment and other data which the contractor submits (this <br /> review is for the benefit of the Owner and covers only general <br /> conformance with the information given by the Contract Documents); <br /> 5) obtain and review month~ and final estimates for payments <br /> to contractors, and furnish to the Owner any recommended payments <br /> to contractors and suppliers; assemble written guarantees which <br /> are required by the Contract Documents; 6) conduct, in company <br /> with the Owner, a final inspection of the Project for compliance <br /> with the Contract Documents, and submit recommendations concerning <br /> project status, as it may affect Owner's final payment to the <br /> contractor. <br /> Our compensation for these services will be on our standard <br /> cost times multiplier basis in accordance with the Schedule of <br /> Charges shown as Attachment A. However, this fee will not <br /> exceed the total amount that would have been due using the percent <br /> of construction cost method of payment based on the actual <br /> construction cost and Curve A as shown on Attachment B. <br /> The compensation ceiling for the Design Phase fee will be 85% <br /> of the Basic Charge from Attachment B and the ceiling for the <br /> General Representation Phase fee will be 15% of the Basic Charge. <br /> The estimate of probable construction cost in the Preliminary <br /> Engineering Report will be used to establish the fee ceiling <br /> until the construction contract 1S awarded. If a construction <br /> contract is not awarded within ninety days from completion of <br /> final plans and specifications, the fee ceiling will be based on <br /> the Engineer's final estimate of probable construction cost or <br /> billable hours worked, whichever is less. <br /> We will perform any additional services as requested and authorized <br /> in writing by the City such as field surveys, construction staking, <br /> preparation of easement information, resident representation <br /> during construction, etc., on a cost times multiplier basis in <br /> accordance with the Schedule of Charges shown as Attachment A. <br />
