<br /> ATTAcmmNT "A", Page 52 <br /> § 10-39 SAN ~IARCOS CODE § 10-,10 <br /> from which no appeal has been taken, or who shall fail to <br /> comply with such an order as affirmed or modified by the <br /> municipal court of the City of San :Marcos or by a court of <br /> competent jurisdiction, within the time fixed herein, shall <br /> severally for each and every such violation and noncompli- <br /> ance respectively, be guilty of a misdemeanor, punishable by <br /> a fine of not less than five dollars ($5.00) nor more than <br /> bvo hundred dollars ($200.00). The imposition of one penalty <br /> for any violation shall not excuse the violation or permit it to <br /> co,1tinue; and all such persons shall be required to correct <br /> or remedy such violations or defects within a reasonable time; <br /> and when not otherwise specified, each ten (10) days that <br /> prohibited conditions are maintained shall constitute a sepa- <br /> rate offense. <br /> (0) The application of the above penalty shall not be held <br /> to prevent the enforced removal of prohibited conditions. <br /> (c) This artic1e shall be applicable and in force within the <br /> area immediately adjacent and contiguous to the city limits of <br /> the City of San l\Iarcos, and extending for a distance outside <br /> the dty limits; pl'Ovided that this article shall not apply 'within <br /> any l)Ortion of such five thousancl (5,000) feet area whic"h is <br /> contained within the territory of any other municipal corpora- <br /> tion.
