INDEf1NITý: Tenù.nt agrees to hold the City harmless and <br /> to indemnify the City from and against any and all claims, <br /> demands and causes OJ: action of every kind and character <br /> which may be asserted by any third party occurring or Tn any <br /> way incident to, arising out of, or In connection with this <br /> lease and agreement, or the omission of Tenant, or as a <br /> consequence of rrenant' s presence upon Airport. Such <br /> indemnification shall include, but not be limited to, the <br /> payment of all cos-ts, attorney's fees, and expenses by Tenant <br /> incidental to the defense of the City against any and all <br /> such l' demands, and causes of action. <br /> c~a1ms, <br /> 7. DEFAULT: This lease and Agreement shall be breached and <br /> Tenant shall be deemed in defaul-t of this lease and agreement <br /> if (a) Tenant shall fail in the payraent of any fee as <br /> required of Tenant under Sec-tion 3 of this lease and <br /> agreement¡ (b) Tenant shall fail in the performance of any <br /> other requirements of Tenant herein, and if such failure <br /> shall continue for five (5) days after receipt by Tenant of <br /> written notice thereof from City. In the event of any breach <br /> of this lease and Agreement by Tenant, City shall, at its <br /> option, have the right to consider this lease and Agreement <br /> terminated and to remove the heretofore described Aircraft <br /> and any other property of Tenant from the said Space, us1ng <br /> such means and forces as City may deem necessary. In such <br /> event Tenant agrees not to charge the City with trespass, <br /> breach of peace, or forceable entry and detainer. <br /> 8. THIRTY DAY TERMINATION: Either party hereto shall have <br /> the right, with or without cause, to terminate this Agreement <br /> by giving thirty (30) days written notice of such termination <br /> to the other party, prior to the date of termination. <br />
