Mr. Robbins said there would be more runoff with MF-4 density but this would be controlled by the Drainage and Erosion Control Ordin- ance. Mr. Jim Byrn responded to Mr. Guerra1s question regarding building in the flood plain by saying water would rise more with the presence of buildings but that this could be offset with excava- tion, which would give basically the same flow characteristics in the area as prior to construction. No one else wished to speak in favor or in opposition to the zoning change, so Mayor Craddock closed the public hearing. Mr. Farr moved for approval of the Ordinance on first reading and Mr. Brown seconded the motion. On roll call the following vote was recorded: AYE: Brown, Coddington, Farr, Craddock, Guerra, Kissler. NAY: Moore. ABSTAIN: None. Mayor Craddock introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING SECTION 5-17, IMPROVEMENTS ON UNPLATTED PROPERTY, OF DIVISION 1 OF ARTICLE II OF CHAPTER 5 OF THE CODE OF ORDINANCES OF SAID CITY TO PROVIDE THAT ANY VARIANCE TO THE REQUIREMENT CONTAINED THEREIN MAY BE GRANTED ONLY BY THE PLANNING COMMISSION OR, ON APPEAL, BY THE CITY COUNCIL AS PROVIDED IN THE SUBDIVISION ORDINANCE, APPENDIX C/ CODE OF ORDINANCES OF SAID CITY; AND DECLARING AN EMERGENCY. Mr. Guerra moved for adoption of the Ordinance and Mayor Craddock se- conded the motion. Mr. Hankins advised the Council the above-refer- enced sections of the Code provided dual jurisdiction, and that it is the Staff's recommendation that this Ordinance be adopted eliminating the dual jurisdiction and providing the Planning Commission be the body to review these variances during the platting process. On roll call the following vote was recorded: AYE: Brown, Coddington, Craddock, Guerra, Kissler, Moore. NAY: None. ABSTAIN: Farr. Mr. Brown moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion, which passed unanimously.
