Mr. <br />Robbins said there would be more runoff with MF-4 density but <br />this would be controlled by the Drainage and Erosion Control Ordin- <br />ance. Mr. Jim Byrn responded to Mr. Guerra1s question regarding <br />building in the flood plain by saying water would rise more with <br />the presence of buildings but that this could be offset with excava- <br />tion, which would give basically the same flow characteristics in <br />the area as prior to construction. No one else wished to speak in <br />favor or in opposition to the zoning change, so Mayor Craddock closed <br />the public hearing. Mr. Farr moved for approval of the Ordinance <br />on first reading and Mr. Brown seconded the motion. On roll call <br />the following vote was recorded: <br /> AYE: Brown, Coddington, Farr, Craddock, Guerra, Kissler. <br /> NAY: Moore. <br /> ABSTAIN: None. <br />Mayor Craddock introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING SECTION 5-17, IMPROVEMENTS ON <br /> UNPLATTED PROPERTY, OF DIVISION 1 OF ARTICLE II OF <br /> CHAPTER 5 OF THE CODE OF ORDINANCES OF SAID CITY TO <br /> PROVIDE THAT ANY VARIANCE TO THE REQUIREMENT CONTAINED <br /> THEREIN MAY BE GRANTED ONLY BY THE PLANNING COMMISSION <br /> OR, ON APPEAL, BY THE CITY COUNCIL AS PROVIDED IN THE <br /> SUBDIVISION ORDINANCE, APPENDIX C/ CODE OF ORDINANCES <br /> OF SAID CITY; AND DECLARING AN EMERGENCY. <br />Mr. Guerra moved for adoption of the Ordinance and Mayor Craddock se- <br />conded the motion. Mr. Hankins advised the Council the above-refer- <br />enced sections of the Code provided dual jurisdiction, and that it <br />is the Staff's recommendation that this Ordinance be adopted eliminating <br />the dual jurisdiction and providing the Planning Commission be the <br />body to review these variances during the platting process. On roll <br />call the following vote was recorded: <br /> AYE: Brown, Coddington, Craddock, Guerra, Kissler, Moore. <br /> NAY: None. <br /> ABSTAIN: Farr. <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE PROJECT PLAN AND FINANC- <br /> ING PLAN OF REINVESTMENT ZONE NUMBER ONE, CITY OF SAN <br /> MARCOS, TEXAS; PROVIDING A SAVINGS CLAUSE; AND DECLAR- <br /> ING AN EFFECTIVE DATE. <br />Mr. Brown moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion, which passed unanimously. <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br />
