<br />23 <br />ORDINANCE 1984-73 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING A SAN MARCOS WATER CONSERVATION <br />PLAN; DIRECTING STAFF TO WORK WITH THE EDWARDS <br />UNDERGROUND WATER DISTRICT AND OTHER PURVEYORS TO <br />DEVELOP A STRATEGY FOR IMPLEMENTING THE WATER RATE <br />SURCHARGE CALLED FOR IN THE SAN MARCOS WATER <br />CONSERVATION PLAN; AMENDING CHAPTER 30, ARTICLE I. IN <br />GENERAL, OF THE CODE OF ORDINANCES OF THE CITY OF SAN <br />MARCOS TO ADD SECTIONS TO BE NUMBERED 30-10, 30-11 AND <br />30-12, RESPECTIVELY, RESTRICTING THE USE OF WATER UPON <br />IMPLEMENTATION OF STAGES 3 AND 4 OF SAID PLAN AND <br />PROVIDING FOR A PENALTY OF NOT LESS THAN FIFTY DOLLARS <br />($50.00) NOR MORE THAN TWO HUNDRED DOLLARS ($200.00) FOR <br />VIOLATIONS OF WATER USAGE RESTRICTIONS UPON <br />IMPLEMENTATION OF STAGE 3 OF SAID PLAN AND PROVIDING FOR <br />A PENALTY OF NOT LESS THAN FIFTY DOLLARS ($50.00) NOR <br />MORE THAN FIVE HUNDRED DOLLARS ($500.00) FOR VIOLATIONS <br />OF WATER USAGE RESTRICTIONS UPON IMPLEMENTATION OF STAGE <br />4 OF SAID PLAN; AND DECLARING AN EMERGENCY. <br /> <br /> <br />WHEREAS, warm spring weather conditions and the lack of <br />rainfall have created an increased water demand in the Edwards <br />region; and, <br /> <br />WHEREAS, the water level of the Edwards Aquifer has decreased <br />significantly because of these conditions; and, <br /> <br />WHEREAS, the City of San Marcos has joined with the Edwards <br />Underground Water District in organizing Operation Water Conservation; <br />and, <br /> <br />WHEREAS, Operation Water Conservation has recommended that <br />communities in the Edwards region adopt water conservation plans to <br />reduce water consumption; and, <br /> <br />WHEREAS, the City Manager was directed by the City Council on June <br />11, 1984, to develop specific plans for implementing Operation Water <br />Conservation in said City; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the San Marcos Water Conservation Plan, a copy of <br />which is attached hereto and incorporated herein by reference, is <br />hereby approved. <br /> <br />SECTION 2. That City staff is hereby directed to work with the <br />Edwards Underground Water District and other purveyors to develop a <br />strategy for implementing the water rate surcharge called for in the <br />Water Conservation Plan, said surcharge to incorporate a "life-line" <br />feature and assure equity within the Edwards region, the implementation <br />of which water rate surcharge the City Council shall consider at some <br />future time. <br /> <br />SECTION 3. That City staff is hereby directed to evaluate the <br />effectiveness of this plan and to report to the City Council by <br />July 23, 1984, for purposes of recommending changes to the water <br />conservation program, if needed. <br /> <br />SECTION 4. That Chapter 30, Article I. In General, of the Code <br />of Ordinances of the City of San Marcos is hereby amended by adding the <br />following sections which shall be numbered 30-10,30-11 and 30-12, <br />respectively: <br /> <br />Sec. 30-10. Restricting the Use of Water - Scope. <br /> <br />(a) The City Manager is authorized to implement Stage 3 <br />(Water Warning) of the San Marcos Water Conservation <br />Plan whenever the water level in the Bexar County <br />observation well is at 612 feet. The order to <br />implement and to terminate Stage 3 (Water Warning) <br />shall be made by public announcement and shall be <br />published a minimum of one (1) time in a daily <br />newspaper of general circulation.
