MBE Program Page 9 In the event of a discrepancy in the information, the firm's owner or representative will be invited to discuss the matter. In the event the decision is made not to certify the company, the owner or repre- sentative shall be advised of the fact that Section 23.55 of 49 CFR Part 23 contains the details of the appeals process for denials of certification as an MBE. A copy of that paragraph shall be furnished to any firm being denied certification. The above procedures may seem strict or even laborious to some, but the City feels a company must be a bonafide minority or women owned and controlled firm to be listed in our Directory. We believe this is necessary for our own protection as well as to achieve the intent of the MBE Program. LEASING GOALS The goals committee (see GOALS) shall be responsible for setting leasing goals at the Airport. The committee shall meet annually. In determining the goal for the upcoming year the committee shall take into considera- tion the following factors: 1. Current leases, 2. The availability of women and minority owned businesses in the business area that are transportation related or or could provide services or supplies to the airport, airport businesses or public using the airport, and 3. Past leasing experience. The initial review period will be for approximately one (1) year. On or before September 1, 1985, and annually thereafter, the committee shall present to the City Council a written revièw of the Airport's performance in regards to MBE leases, comparing the actual MBE leasing percentage to that of the goal, and projected versus actual participation. In the event that the projected level of participation by MBE's is not met during the goal period, the committee must demonstrate to the City Council that a reasonable effort was made to attempt to meet the MBE goals. New goals shall be drawn up annually, and shall be presented in writing to the City Council for review and P.A.A. approval.
