<br /> MBE Program <br /> Page 3 <br /> shall be deemed equivalent to having MBE participation <br /> in 25.0% of the work. MBE members of the joint venture <br /> must have either financial, managerial, or technical <br /> skills ln the work to be performed by the joint venture. <br /> D. Bidder--Any person, firm, partnership, corporation, association, <br /> or joint venture as herein provided seeking to be awarded a <br /> City contract or agreement. <br /> E. Contractor--Any person, firm, partnership, corporation, associ- <br /> tion, or joint venture as herein provided which has been awarded <br /> a City contract or agreement. <br /> F. Subcontractor--Any named person, firm, partnership, corporation, <br /> association, or joint venture as herein provided identified as <br /> providing work, labor, services, supplies, equipment, materials, <br /> or any combination of the foregoing, under contract with a prime <br /> contractor on a City contract. <br /> G. Goal--A flexible target to be achieved during a twelve-month <br /> period or during the term of a particular contract based on staff <br /> estimates of the availability of qualified minority business <br /> enterprises (MBE's) ln the San Marcos trade area and known <br /> circumstances and conditions. In no case shall a goal be construed <br /> as constituting a fixed quota. <br /> IMPLEMENTATION OF POLICY <br /> In order to facilitate the implementation of the MBE Program, the City <br /> of San Marcos shall keep an up-to-date directory of all minority and <br /> women owned businesses within the San Marcos trade area. This area <br /> shall include Austin, San Antonio, New Braunfels, and other corridor <br /> cities. The San Marcos Municipal Airport as well as any other depart- <br /> ment of the Ci ty which has or shares responsibility for the awarding of <br /> airport contracts and/or contract administration will be held <br /> responsible and accountable for exercising the duties and responsibilities <br /> set forth herein, as well as any other function deemed necessary by the <br /> City Council. The following departments of the City of San Marcos shall <br /> have specific MBE implementation responsibilities as follows: <br /> A. Municipal Airport <br /> ( 1) provide information on the sponsor organization, functions <br /> and its full range of contractual needs, pertaining to the <br /> airport. <br /> ( 2) offer instructions and clarification on bid specifications, <br /> procurement policy, procedures, and general bidding <br /> requirements. <br />
