Ken Kraus was present re- <br />presenting Messrs. Rockford and Salinas to answer any questions of <br />the Council. No one else wished to speak in favor or in opposition <br />to the zoning request, so Mayor Craddock closed the public hearing. <br />Mr. Farr moved for approval of the Ordinance on first reading and Mr. <br />Guerra secomed the motion. On roll call the following vote was re- <br />corded: <br /> <br />AYE: Brown, Coddington, Farr, Craddock, Guerra. <br /> <br />NAY: Moore. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Craddock introduced for consideration a public hearing and ap- <br />proval of an Ordinance on first reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY CHANGING THE ZONING OF LOT 3, IN <br />THE PECAN CREEK ADDITION, SECTION 2, A SUBDIVISION <br />OF RECORD IN VOLUME 3, PAGE 52 OF THE PLAT RECORDS <br />OF HAYS COUNTY, TEXAS, AS SHOWN ON THE MAP OR PLAT <br />THEREOF, AIKIA 411 AND 413 W. SAN ANTONIO, FROM "c" <br />(COMMERCI.AL DISTRICT) TO "MF-4" (MULTI-FAMILY DISTRICT) i <br />AMENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER <br />PLAN OF SAID CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock opened the public hearing and asked if anyone wished <br />to speak in favor of the zoning request. Robert McDonald stated he <br />owns the property along with Pud Rutledge and because of the morator- <br />ium and the need for a Master Plan amendment, they have been delayed <br />two years from developing their property. Floyd MacKenzie asked Mr. <br />McDonald when the property was purchased, and Mr. McDonald replied in <br />February, 1983. No one else wished to speak in favor of the zoning re- <br />quest, so Mayor Craddock asked if anyone wished to speak in opposition. <br />Floyd MacKenzie stated he opposed the zoning change before the Zoning <br />Commission and was still opposed to the zoning change. He asked <br />Council if they thought it would be more valuable for the City to have <br />a multi-family development instead of two older, lovely homes. He said <br />the property has deteriorated since ownership by Mr. McDonald. He said <br />the traffic would increase and that the City needs to have infrastructure <br />in place before allowing this project and respectfully submitted the <br />Council deny the zoning request. Frank Robbins stated a traffic count <br />had been done and the roadway would adequately carry the increased <br />count if this project were to be approved. Lamar Hankins asked Frank <br />Robbins about the Zoning Commission approving the zoning request "with <br />a six foot privacy fence to be erected around the subject property", <br />and Mr. Robbins said he thought it was a requirement of the Landscap- <br />ing and Buffering Ordinance. Mr. McDonald responded two sides were <br />already fenced. No one else wished to speak for or against the zoning <br />change, so Mayor Craddock closed the public hearing. Mr. Guerra moved <br />for approval of the Ordinance on first reading and Mr. Farr seconded <br />the motion. Mr. Moore said he did not think the City was staying in <br />compliance with the Master Plan regarding multi-family high density. <br />Frank Robbins reviewed the L&B Ordinance and stated a fence was required <br />between commercial and industrial next to residential use. Mayor Craddock <br />stated she thoughtthe buffering should be included in this Ordinance. <br />Floyd MacKenzie stated the "medallion" home has deteriorated and a <br />privacy fence between the McDonald/Rutledge property and the Yoakum's <br />property would help to buffer the noise of a multi-family development. <br />
