<br />28 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting March 25, 1985 Page 3 <br /> <br /> <br />On roll call the following vote was recorded: <br />AYE: Coddington, Farr, Craddock, Guerra. <br />NAY: Brown, Moore. <br />ABSTAIN: None. <br /> <br />Mayor Craddock introduced for consideration a public hearing and ap- <br />proval of an Ordinance on first reading, the caption which was read <br />as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS ,TEXAS, AÞ1ENDING SECTION 30-7 OF ARTICLE I <br />OF CHAPTER 30 OF THE CODE OF ORDINANCES OF SAID CITY <br />TO INCREASE THE AMOUNT OF DEPOSITS FOR ALL NEW CON- <br />NECTIONS FOR UTILITY SERVICES TO INDIVIDUALLY METERED <br />RESIDENTIAL UNITS TO $45.00 AND TO COMMERCIAL ESTABLISH- <br />MENTS AND ALL RESIDENTIAL UNITS NOT METERED INDIVIDUALLY <br />TO TWO (2) TIMES THEIR ESTIMATED AVERAGE MONTHLY BILL <br />OR $60.00, WHICHEVER IS GREATER; AND DECALRING AN EF- <br />FECTIVE DATE. <br /> <br />Mayor Craddock opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the amendments. Wayne Moore of <br />the Utility Department addressed the Council to advise the Council <br />of the necessity for the deposit increases. No one else wished to <br />speak in favor or in opposition to the amendments, so Mayor Craddock <br />closed the public hearing. Mayor Craddock moved for approval of the <br />Ordinance on first reading and Mr. Coddington seconded the motion. Mr. <br />Guerra asked Mr. Moore if the deposit was refunded when the account is <br />closed, and Mr. Moore stated it is. Mr. Coddington stated he thought <br />it was appropriate to raise the commercial deposit but not the resi- <br />dential deposit. Mr. Moore stated half of the unpaid utility bills <br />were residential and stated $35.00 deposit does not cover the unpaid <br />bills and the City needs to include the residential increase, that <br />$45.00 is warranted on residential. Mr. Coddington moved to amend <br />the residential units remain at $35.00 and commercial establishments <br />and all residential units not metered individually to two times their <br />estimated average monthly bill or $60.00, whichever is greater be <br />approved and Mr. Moore seconded the motion. Mr. Farr then moved the <br />Ordinance be tabled until April 8 and Mr. Brown seconded the motion. <br />On roll call the following vote was recorded: <br /> <br />AYE: Brown, Coddington, Farr, Craddock, Moore. <br /> <br />NAY: Guerra. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND <br />CONTAINING 108.8490 ACRES, MORE OR LESS, OUT OF THE <br />J. M. VERAMENDI LEAGUE NO.1, THE N. HUBBARD SURVEY <br />NO. 35 AND THE ED BURLESON SURVEY NO. 63, IN HAYS <br />COUNTY, TEXAS, SAID LAND BEING LOCATED WITHIN THE <br />EXTRATERRITORIAL JURISDICTION OF SAID CITY AND LYING <br />ADJACENT TO PRESENT CITY BOUNDARIES; APPROVING A <br />SERVICE PLAN FOR SAID TRACT; EXTENDING THE BOUNDARY <br />LIMITS OF SAID CITY SO AS TO INCLUDE SAID TRACT; <br />GPANTING TO THE INHABITANTS OF SAID TRACT ALL THE <br />RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF SAID CITY; <br />BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDIN- <br />ANCES, RULES AND REGULATIONS OF SAID CITY; AND DECLAR- <br />ING AN EFFECTIVE DATE. <br />
