<br /> -4- <br /> 13. Residential Unit--A dwelling wi thin the <br /> corporate limits of the City occupied by a <br /> person or group of persons. A residential <br /> unit shall be deemed occupied when either <br /> water or domestic light and power services <br /> are being supplied thereto. A townhouse, <br /> apartment, fourplex, duplex or condominium, <br /> whether of single or multilevel construction, <br /> or mobile homes, shall be treated as a <br /> residential unit. <br /> 14. Restaurant--A building or portion of a <br /> building where the primary business is the <br /> on-premises sale of prepared food, with <br /> adequate kitchen facilities for the <br /> preparation of the food to be sold. <br /> 15. Structure--Anything constructed, erected or <br /> artificially built up; or composed of parts <br /> and joined together in a permanent manner. <br /> 16. Single Family Residential Unit--A structure <br /> designed for and occupied exclusively as a <br /> separate dwelling unit. <br /> 17. Towrihouse--A single-family dwelling unit <br /> constructed in a series, or a group of units <br /> having common walls, each on a separate lot. <br /> 18. Definitions not provided in this section <br /> shall be taken from available City Codes or <br /> Ordinances, where applicable. <br /> Section 30-42. Payment of Charge. <br /> Prior to connection of any building, premises or <br /> lot after the effective date of this Ordinance <br /> to any water system which utilizes the water <br /> distribution system of the City of San Marcos, <br /> the owner of that building, premise or lot shall <br /> pay a capital recovery fee for new construction <br /> to said City. <br /> Section 30-43. Time of Payment. <br /> Capital recovery fees for new construction shall <br /> be paid at the time of the issuance of the <br /> building permit for the building, premise or lot <br /> to be added to the water system, and no <br /> prepayment shall be allowed except as may be <br /> provided under conditions specified in Section <br /> 30-49. <br /> Section 30-44. Amount of Charge for New <br /> Construction. <br /> The Capital Recovery Fee (CRFN) for any <br /> building, lot or premise, shall be computed <br /> using the following formula: <br /> Capital Recovery Fee for New Construction <br /> (CRFN)= fee charged for new development. <br /> Living Unit Equivalent (LUE)= unit of <br /> development which produces the same flow of 630 <br /> gallons water use per day as derived in Section <br /> 30-45. <br /> Capital Recovery Fee = $l,lOO/LUE. <br />
