<br />A RESOLUTION OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, APPROVING THE
<br />TERMS AND CONDITIONS OF AMENDMENTS NOS. 4 AND 5
<br />TO THAT CONTRACT OF MAY 7, 1979, BETWEEN
<br />SAID CITY AND FREESE AND NICHOLS, INC.
<br />FOR THE PROVISION OF ENGINEERING SERVICES IN
<br />CONNECTION WITH WASTEWATER SYSTEM IMPROVEMENTS
<br />IN SAID CITY; AUTHORIZING THE CITY MANAGER
<br />OF SAID CITY TO EXECUTE SAID AMENDMENTS NOS. 4 AND 5
<br />AND DECLARING AN EFFECTIVE DATE.

<br />
<br />WHEREAS, the City of San Marcos, Texas, entered into a contract
<br />with Freese and Nichols, Inc., on May 7, 1979 for the provision of
<br />engineering services in connection with proposed improvements to the
<br />City's wastewater collection system; and,
<br />
<br />WHEREAS, said Contract has subsequently been amended on May 19,
<br />1980, August 3, 1982 and November 9, 1982; and,
<br />
<br />WHEREAS, the City Council of said City wishes to further amend
<br />said Contract; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />PART 1. That the terms and conditions of Amendment No.4 To
<br />Contract For Engineering Services, said contract entered into on May 7,
<br />1979 by the City of San Marcos, Texas, and Freese and Nichols, Inc., a
<br />copy of which Amendment No.4 is attached hereto and incorporated
<br />herein for all intents and purposes, be, and the same are hereby,
<br />approved in all respects.

<br />PART 2. That the terms and conditions of Amendment No.5 To
<br />Contract For Engineering Services, said contract entered into on May 7,
<br />1979 by the City of San Marcos, Texas, and Freese and Nichols, Inc., a
<br />copy of which Amendment No.5 is attached hereto and incorporated
<br />herein for all intents and purposes, be, and the same are hereby,
<br />approved in all respects.
<br />
<br />PART 3. That the City Manager of the City of San Marcos, Texas,
<br />A. C. Gonzalez, be, and he is hereby, authorized to execute said
<br />Amendments Nos. 4 and 5 'ro Contract For Engineering Services on behalf
<br />of said City.
<br />
<br />PART 4. That this Resolution shall be in full force and effect
<br />from and after its passage.
<br />
<br />ADOPTED this 13 day of August, 1984 .
