<br /> AMENDMENT NO.4 TO CONTRACT FUR ENGINEERING SERVICES <br /> The Contract for Engineering Services dated I/lay 7, 1979, Amendment No.1 <br /> dated ~lay 19, 1980, Amendment No.2 dated August 3, 1982, and Amendment <br /> No.3 dated November 9, 1982, by the CITY OF SAN I1ARCOS, TEXAS, and FREESE <br /> AND NICHOLS, INC., shall be amended as set forth hereunder. The said <br /> Contract and Amendments Nos. 1,2, and 3 are attached as Attachment A. <br /> 1. Section 2, Character and Extent of Services, shall be <br /> modified as follows: <br /> c. General Representation and Observation During <br /> Construction: Delete the last paragraph and replace <br /> wlth the following: <br /> "The Engineer shall conduct qualification <br /> investigations of selected material and equipment <br /> suppliers during the advertisement phase of the <br /> project and advise the Owner of the findings of these <br /> investigations. The Owner will make the final <br /> determination as to who has been prequalified to bid <br /> on the project and the Owner shall notify the <br /> prospective suppliers of their decision. <br /> "Engineer will also prepare Operation and ¡'Iaintenance <br /> Manuals for the facilities to be constructed. The 0 & <br /> M Manuals will be prepared for submittal to the Owner <br /> after final acceptance of construction of the <br /> facilities. <br /> The Engineer shall provide project performance <br /> services to familiarize the Owner's operation <br /> personnel in the operation and maintenance of the <br /> facilities. The services shall include a maximum of <br /> five eight (8) hour days after initial start-up of the <br /> facilities and one eight (8) hour day per month during <br /> the first twelve months of operation. The duties, <br /> responsibilities, and limitations of the Engineer in <br /> performing these services are set forth in Attachment <br /> C." <br /> 1 <br />
