<br /> of land are not a part of this contract. The Owner <br /> shall pay for costs of land surveys and shall compensate <br /> the Engineer for services rendered in connection with <br /> condemnation proceedings. <br /> 3. Compensation to Engineer: The Owner agrees to pay the <br /> Engineer for all professional services rendered under this contract <br /> in accordance with the following: <br /> a. Step I Preliminary Engineering and Planning: The <br /> Engineer shall be compensated a lump sum of One Hundred <br /> Seven Thousand, Eighty Eight Dollars ($107,088) for <br /> the services described in Section 2.a above. <br /> b. Designs, Plans and Specifications: The compensation <br /> for serVlces in connectlon with furnishing Step II <br /> design, plans and specifications as presented in Para- <br /> graph 2.b shall be determined by mutual consent at <br /> the time an application is submitted by the Owner <br /> for Step II grant funds. <br /> c. General Representation and Resident Representation <br /> During Construction: The compensation for services <br /> 1n connection with General Representation and Resident <br /> Representation during construction, as presented in <br /> Paragraph 2.c and 2.d, shall be determined by mutual <br /> consent at the time an application is submitted by <br /> the Owner for Step III, Construction, grant funds. <br /> 4. Time of Compensa t i on: Payment for servi ces rendered by <br /> the Engineer shall be made as follows: <br /> a. For Step I services the Engineer may submit requests <br /> for partial payment monthly based on the amount of <br /> work completed in each task set forth in the Plan <br /> of Study of the grant application; however, the sum <br /> total of these payments shall not exceed ninety (90%) <br /> percent of the total fee or 90 percent of any task <br /> cost at the time of submittal of the Facility Plan <br /> to the Ol-mer. The final ten (10%) percent of the <br /> fee shall be due and payable upon approval and certifik <br /> cation of the Facility Plan by the Texas Department <br /> of Water Resources and the U.S. Environmental Protection <br /> Agency. <br /> b. For designs, plans and specifications for each item in <br /> Paragraph 1, the Engineer may submit requests for <br /> 5. <br />
