<br /> pa r t i a 1 payment based on the amount of work completed, <br /> however, the sum total of these payments shall not <br /> exceed ninety (90%) percent of the total fee at the <br /> time of submittal of final plans and specifications <br /> to the Owner. The final ten (10%) percent of the <br /> fee shall be due and payable upon approval of the <br /> plans and specifications by the Texas Department of <br /> Water Resources and the Environmental Protection Agency. <br /> c. For general and resident representation during con- <br /> struction, payment shall be made on a monthly basis, <br /> based on the estimated percentage of completion of <br /> construction at the time of billing. <br /> 5. Federal Requirements: The provisions established by the <br /> Environmental Protection Agency known as Appendix C-l to 40 CFR Part <br /> 35, Subparagraph E, as published in the Federal Register are part <br /> of this agreement. Appendix C-l is attached as Attachment B. It <br /> is mutually agreed that all references to other paragraphs in Federal <br /> Regulations and Guidelines shall refer to those in effect at the <br /> time of the execution of this Contract. <br /> The Engineer will endeavor to meet the guidelines of En- <br /> vironmental Protection Agency, Region VI for Minority Business <br /> Employment and will keep the Owner advised of these matters throughout <br /> the Project. <br /> 6. Preliminary Estimates: When requested to do so, the Engi- <br /> neer will furnish estimates of probable construction cost of the <br /> work but he does not guarantee the accuracy of such estimates. <br /> 7. Revisions of Plans and Specifications: The Owner reserves <br /> the right to direct substantial revision of the plans and specifi- <br /> cations after due approval by the Owner as Owner may deem necessary, <br /> but in such event the Owner shall pay to the Engineer just and equit- <br /> able compensation for services rendered in making such revisions. <br /> If revisions in the plans, specifications or drawings are required <br /> by reason of the Engineer's error or omission, then such revisions <br /> will be made by the Engineer without additional compensation to the <br /> fees herein specified. <br /> 8. Inspection and Review of the Work: The Engineer will endeavor <br /> to protect the Owner against defects and deficiencies in the work <br /> of Contractor(s), by inspection and observation of the work as it <br /> 6. <br />
