Paragraph 4, Time of Compensation, as shown in the original agreement, <br /> shall be modified as set forth herein. <br /> Delete paragraph 4.a. and add new paragraph 4.a.as follows: <br /> a. For Step I services the Engineer may submit requests for partial <br /> payment monthly based on the amount of vJOrk completed in each <br /> task set forth in the Plan of Study of the original grant appli- <br /> cation and amendment thereto to include the Sewer System Evalua- <br /> tion Survey based upon the following guidelines: <br /> (1) Up to 80% of the amount for each task before submission <br /> of the work. <br /> (2) Up to 90% of the amount for each task after work is <br /> certified by TDWR. <br /> (3) The remaining 10% for each task when all the work called <br /> for in the Step. I grant is completed, approved, and <br /> certified by TDWR and EPA. <br /> 4. Paragraph 11 of Attachment B to the original contract is reproduced <br /> below for emphasis. <br /> 11. SUBCONTRACTS <br /> " ( a) Any subcontractors and outside associates or consultants required by <br /> the engineer in connection with services under this agreement will be limited <br /> to such individuals or firms as were specifically identified and agreed to <br /> during negotiations, or as the owner specifically authorizes during the per- <br /> fonlliHlce of this (lgrcement. The m.mer must give prior approval for any sub- <br /> stitutes in or additions to such subcontractors, associated, or consultants. <br /> ( b) The Engineer may not subcontract services in excess of thirty (30) <br /> percent (or -- percent, if the O\-'lner and the engineer hereby agree) of the <br /> contract price to subcontractors or consultants without the owner's prior <br /> written approval." <br /> It is the intent of Freese and Nichols, Inc. to subcontract approximately 85 <br /> percent of the Sewer System Evaluation Survey to McCullough Associates, Inc., <br /> Dallas, Texas.
