<br /> -2- <br />Sec. 2-73. Standards of conduct. <br /> . . . <br /> (b) No city officer or employee shall knowingly: <br /> . . . <br /> (3) Represent, directly or indirectly, any other <br /> private person, including the officer or <br /> employee or any member of his/her immediate <br /> family, or any group, or interest in a <br /> criminal proceeding in which any city officer <br /> or employee is a material witness for the <br /> prosecution. <br /> . .. <br />SECTION 3. That Section 2-73 of Division 1 of <br />Article v. Code of Ethics of Chapter 2 of the Code of <br />Ordinances of the City of San Marcos, Texas is hereby amended <br />to delete Section 2-73 (b) (5) in its entirety. <br />SECTION 4. That Section 2-73 of Division 1 of <br />Article v. Code of Ethics of Chapter 2 of the Code of <br />Ordinances of the City of San Marcos, Texas is hereby amended <br />to add subsections (c), (c) (1) and (c) (2) which shall read as <br />follows: <br />Sec. 2-73. Standards of conduct. <br /> . . . <br /> ( c) No officer or employee shall knowingly <br /> represent, directly or indirectly, any private <br /> person including the officer or employee or any <br /> member of his/her immediate family, or any group or <br /> interest before any deparbnent, agency, commlSSlon <br /> or board of the City of San Marcos, except as <br /> follows: <br /> ( 1) No officer or employee shall be prohibited <br /> from representing his/her interests in his/her <br /> owner-occupied homestead before a board, <br /> agency, commission or department of the City <br /> of San Marcos other than those of which the <br /> officer is a member and those by which the <br /> employee is employed. <br /> (2) No officer or employee shall be prohibited <br /> from representing a private person, group or <br /> interest before a board, agency, department or <br /> commission of the City of San Marcos, other <br /> than those of which the officer is a member <br /> and those by which the employee is employed, <br /> in matters of purely civic or public concern <br /> when doing so without compensation or <br /> remuneration. <br /> . .. <br />SECTION 5. That Section 2-73 of Division 1 of <br />Article v. Code of Ethics of Chapter 2 of the Code of <br />Ordinances of the City of San Marcos, Texas is hereby amended <br />to add subsections (d), (d) (1) and (d) (2) which shall read as <br />follows: <br />Sec. 2-73.
