<br /> -3- <br /> . . . <br /> (d) In any action or proceeding in the municipal <br /> courts of the City of San Marcos which was <br /> instituted by a city officer or employee in the <br /> course of official duties, <br /> (1) No City Council member, including the mayor, <br /> shall knowingly represent any private person, <br /> including him/herself or any member of his/her <br /> immediate family, or any group or interest. <br /> ( 2) No city officer or employee, other than the <br /> mayor and city council members, shall <br /> knowingly represent any private person other <br /> than him/herself, including any member of <br /> his/her immediate family, or any group or <br /> interest; but said officer or employee is not <br /> prohibited from representing him/herself in <br /> said municipal court action or proceeding. <br />SECTION 6. That Section 2-73 of Division 1 of <br />Article V. Code of Ethics of Chapter 2 of the Code of <br />Ordinances of the City of San Marcos, Texas is hereby amended <br />to add subsection (e) which shall read as follows: <br /> Sec. 2-73. Standards of conduct. <br /> . . . <br /> (e) No officer or employee shall be deprived of <br /> his/her right to due process under the law which <br /> would include the right to represent <br /> himself/herself in a court proceeding, except as <br /> provided in this ordinance. <br />SECTION 7. 'rhat the definition of "City official" in <br />Section 2-81 of Division 2 of Article V. Code of Ethics of <br />Chapter 2 of the Code of Ordinances of the City of San <br />Marcos, Texas is hereby amended to read as follows: <br />Sec. 2-81. Definitions. <br />City official: The mayor, every member of the city <br />council, the city manager, the city attorney, the city <br />secretary, judges of the municipal court, and persons <br />acting in the capacity of the aforementioned officers or <br />employees. If the job title of city manager, city <br />attorney, city secretary and judges of the municipal <br />court or any of them are changed, the term "city <br />official" shall include the persons charg ed with the <br />duties of the listed positions. <br />SECTION 8.
