<br /> 21 <br /> RESOLUTION 1984-82R <br /> A REffiWTION OF THE CI'IY COUNCIL OF THE CI'IY OF SAN <br /> MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A <br /> DRAINAGE STRUCTURE LICENSE AGREEMENT WI TH MISffiURI- <br /> KANSAS-TEXAS RAI IROAD COMPANY FDR THE <br /> CONSTRUCTION, RECONSTRUCTION, USE, MAINTENANCE, <br /> OPERATION, REPAIR AND INSTALLATION OF A 24-INCH DROP <br /> INLET PIPE WI TH GRATE AND OUTFALL PIPE ON SAID <br /> MISffiURI-KANSAS-TEXAS RAI IROAD COMPANY'S RIGHT-OF-WAY <br /> LCCATED IN THE VICINI'IY OF RIO VISTA PARK AT THE SAN <br /> MARCOS RIVER IN SAID CI'IY; AUTHORIZING THE MAYOR OF SAID <br /> CI'IY 10 EXECUTE SAID LICENSE AGREEMENT ON BEHALF OF SAID <br /> CI'IY; AUTHORI ZI NG AND APPROVING THE EXPENDI'IURE OF <br /> $990.00 CONSIDERATION FDR THE GRANTING OF SAID LICENSE <br /> BY SAID RAIIROAD; AUTHORIZING THE SAID RAIIROAD COMPANY <br /> 10 PROCEED AND DECLARING AN EFFOCTIVE DATE. <br /> BE IT REffiLVED BY THE CI'IY COUNCIL OF THE CI'IY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the proposed agreement <br /> for a Drainage Structure License between said City and Missouri-Kansas- <br /> Texas Railroad CoITpany for the construction, reconstruction, use, <br /> maintenance, operation, repair and installation of a 24-inch drop inlet <br /> pipe with grate and outfall pipe on said Missouri-Kansas-Texas Railroad <br /> Company's right-of-way located in the vicinity of Rio Vista Park at the <br /> San Marcos River in said City, a copy of which license agreement is <br /> attached hereto and incorporated herein for all purposes, are hereby in <br /> all things approved. <br /> PART 2. That the Mayor of said City, Emmie Craddock, be and she <br /> is hereby authorized to execute said license agreement on behalf of <br /> said City. <br /> PART 3. That the expenditure of $990.00 as consideration for the <br /> granting of said license by said railroad is hereby authorized and <br /> aproved. <br /> PART 4. That the execution by said City of said license agreement <br /> and the adoption of this Resolution and transmittal of same to the said <br /> Missouri-Kansas-Texas Railroad CoITpany shall constitute notice to said <br /> Railroad Company to proceed pursuant to said license agreement. <br /> PART 5.
