<br /> 22 <br /> DRAINAGE STRUCTURE LICENSE <br /> THIS AGREEMENT MADE this 10 day of September , <br /> 1984, by and between the MISSOURI-KANSAS-TEXAS RAILROAD COMPANY, hereinafter <br /> called "Licensor," and the City of San Marcos, hereinafter called <br /> "Licensee." <br /> WIT N E SSE T H <br /> ARTICLE I <br /> 1. This agreement shall take effect the date hereof, and unless <br /> sooner terminated as provided herein, shall continue in force for twenty <br /> (20) years from the date hereof. Any renewals of this license at the end of <br /> the original term shall be in accordance with the mutual agreements of the <br /> parties at that time. <br /> 2. Consideration and Description: In consideration of NINE <br /> HUNDRED NINETY AND NO/lOO ($990.00) DOLLARS, the receipt of which is hereby <br /> acknowledged, and of the covenants of Licensee as hereinafter set forth, <br /> Licensor hereby grants a license and permission to Licensee to construct, <br /> reconstruct, use, maintain, operate, repair and install a 24-inch drop inlet <br /> pipe with grate and outfall pipe on Licensor's right of way at or near San <br /> Marcos in the County of Hays and State of Texas. For convenience, the said <br /> drop inlet pipe and grate is hereinafter referred to as "Drainage <br /> Structure". The location of said Drainage Structure is more particularly <br /> described as follows: <br /> All as shown on Licensor's print of Drawing No. <br /> A-30,9l9, Engineering Department, Denison, <br /> Texas, dated January 26, 1984, marked Exhibit <br /> "A", attached hereto and made a part hereof. <br /> ARTICLE II <br /> Licensee undertakes and agrees: <br /> 1.
