<br /> 3. Approval of the Letter of Credit is only for the rese.L..Y...£.tiQ1l <br /> of package plant capacity. Projects will have to comply with all <br /> other City, State, and Federal requirements. These include, but, <br /> are not limited to, requirements such as wastewater and water <br /> capital recovery fees, site development permits, building codes <br /> and permits, business licenses, state or federal restrictions for <br /> permits, etc. <br /> 4. The package plant reservation is not transferrable to another <br /> entity except in the normal development sequence. Developers may <br /> petition the City to buy back unused package plant capacity <br /> whereupon the City, at its option, may buy this capacity for <br /> redistribution. <br /> 5. After an individual developer has obtained a reservation for <br /> interim capacity, and the contracts for package plantCs) have been <br /> awarded by the City Council, he may recelve a building permit <br /> provided: <br /> a. All applicable rules and regulations have been met; <br /> b. It is clearly understood, no certificate of occupancy <br /> will be issued unless: <br /> 1) the package plant improvement is in place and <br /> operational, or <br /> 2) the owner has provided facilities to dispose of <br /> wastewater in a manner consistent with all city, state, <br /> and federal requirements. <br /> c. It is understood the City is D.Q..t. guaranteeing that the <br /> package plant will be completed on any specific date, and <br /> takes no responsibility for any damages which may be suffered <br /> by the owner if the development project is completed before <br /> the package plant is operational. <br /> Each building permit issued under these conditions shall contain a <br /> statement by the developer that he understands and agrees to the <br /> terms and will set out the arrangements which will insure <br /> wastewater disposal will be handled. <br /> Enclosed is a Letter of Credit form. This document, properly <br /> completed, will serve as your application for interim capacity. We <br /> realize this process has been a burden on many of you, but we feel we <br /> are nearing the point that utility hook-ups will be much more <br /> predictable in the future.
