<br />AN ORDINANCE OF 'IRE CITY COUNCIL OF 'IRE CITY OF SAN
<br />~ MARCOS, TEXAS, PROHIBITING DISCRIMINATION IN FUBLIC
<br />. ACCOMMODATIONS WITHIN 'IRE CORroRATE LIMITS OF THE CITY
<br />OF SAN MARCOS; ESTABLISHING PENALTIES FOR VIOLATIONS;
<br />AND DECLARING AN EFFECTIVE DATE.

<br />
<br />WHEREAS, the City Council has received reports of unlawful acts of
<br />racial and ethnic origin discrimination within the City of San Marcos
<br />in places of public accorrmodation; and,
<br />
<br />WHEREAS, such discrimination is a violation of the Federal Civil
<br />Rights Act of 1964; and,
<br />
<br />WH~S, such discrimination is intolerable to the City Council
<br />and citizens of the City of san Marcos; and,
<br />
<br />WHEREAS, the City Council desires to establish an appropriate
<br />local remedy for such discrimination; therefore,
<br />
<br />BE IT ORDAINED BY 'IRE CITY COUNCIL OF 'IRE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That a Chapter 34 of the Code of Ordinances of the
<br />City of San Marcos, Texas, is hereby created and it shall read as
<br />follows:
<br />
<br />Section 34-1. Title.
<br />
<br />This Chapter shall, from and after the date of its
<br />adoption, be known, cited, and called the "Public
<br />Accorrmodations Ordinance of the City of San Marcos, Texas."
<br />
<br />Section 34-2. Authority.
<br />
<br />This Chapter is adopted pursuant to the Authority of
<br />Article I, Section 3A and Article 11, Section 5 of the
<br />Constitution of the State of Texas, Articles 1165 and 1175,
<br />Revised Civil Statutes of Texas, §11.611, Tex. Alco. Sev.
<br />Code, 42 U.S.C.A. 2000a, et.seq., and. Sections 1.02, 2.01,
<br />3.07 and 12.10 of the Charter of the City of San Marcos,
<br />Texas.

<br />Section 34-3. Purpose.
<br />
<br />It is hereby declared to be the policy of the City to
<br />requlre equal access by all persons in and to places of
<br />public accorrmodation and to prohibit discrimination on
<br />account of race, color, religion, status or national
<br />origin in places of public accorrmodation within the City.
<br />
<br />Section 34-4. Definition of terms.
<br />
<br />For the purposes of this Chapter, the following terms or
<br />words in their derivation shall have the meaning described
<br />and defined in this section.
<br />
<br />a. City: The Ci ty of San Marcos, Hays County, Texas.
<br />
<br />b. Place of Public Þccorrmodation: Any place, store,
<br />business, or other establishment, either licensed or
<br />unlicensed which supplies goods or services to the
<br />general public and shall include, but not be limited
<br />to, the following types of services or facilities,
<br />to-wit: hotels, or other establishments which provide
<br />lodging to transient guests; restaurants, cafeterias,
<br />lunchr(X)ffiS, lunchcounters, soda fountains or other
<br />facilities principally engaged in selling or offering
<br />for sale food for consumption upon the premises;
<br />rrotion picture houses, theaters, concert halls, sport
<br />arenas, stadiums or other places of exhibition or
<br />entertainrœnt; bowling alleys and amuserœnt parks; all
<br />retail establishments; all transportation carriers
<br />and mobile home parks; barber shops; beauty shops;
