<br /> bars or taverns or other facilities engaged in selling
<br /> or offering for sale a 1coho li c beverages for
<br /> consumption upon the premises; and public burial
<br /> facili ties.
<br />d. Person: Any individual, corporation, partnership,
<br /> commercial enterprise 1 association, labor organization
<br /> legal representative, as well as a natural person,
<br /> male or female.
<br />e. Status: The term status means any grouping or
<br /> class i fica tion into which a person may be placed and
<br /> thereby subjected to differential treatment based upon
<br /> his or her physical, rental, emotional, cultural,
<br /> educational, ethnic, sexual, and/or religious
<br /> characteristics, except to the extent that those
<br /> distinctions may be authorized or required by state,
<br /> federal, or local law or ordinance.
<br />Section 34-5. Exemptions.
<br />Nothing in this Chapter shall:
<br />a. Apply to the rental of rooms in an owner-occupied house
<br />or in a owner-occupied dwelling used exclusively as a
<br />rooming house which contains not more than three rooms for
<br />for rent or hire.
<br />b. Apply to a private club or other establishment not in
<br />fact open to the public, except to the extent that the
<br />facilities of such establ ishment are made available to the
<br />custorœrs or patrons of an establishrœnt enurœrated in the
<br />definition of place of public accommodation.
<br />Section 34-6. Acts prohibited.
<br />It shall be unlawful for any person:
<br />a. as owner, lessee, manager, proprietor,
<br />concessionaire, custodian, agent, or employee, of a place of
<br />public accommodation as defined herein to discriminate in
<br />denying, refusing, rejecting, or granting any privilege,
<br />service, goods, merchandise, commodity, facilities,
<br />advantage, or accommodation on account of any person's race,
<br />color, religion, status, ethnic origin, or national
<br />origin.
<br />b. as owner, lessee, manager, proprietor, concessionaire,
<br />custodian, agent, or employee of a place of public
<br />accommodation as defined herein to discriminate by
<br />segrega ti ng or requiring the placing of any person in any
<br />separate section or area of the premises or facilities of
<br />such place of public accommodation on account of his race,
<br />color, religion, status, ethnic origin, or national
<br />origin.
<br />Section 34-7. Penal ty.
<br />Any person violating any provision of this Chapter within
<br />the corporate 1 imi ts of the City of San Marcos shall be
<br />guilty of a Class C Misdemeanor, and upon conviction shall be
<br />fined an amount not less than two hundred dollars ($200.00)
<br />nor more than one thousand dollars ($1,000.00). Each day
<br />that such violation occurs or continues shall be a separate
<br />offense. Prosecution or conviction under this provision
<br />shall not be a bar to any other remedy or relief available
<br />under the law for viola tions of this Chapter. In addition to
<br />the foregoing, any owner and/or operator of a business that
<br />violates this ordinance may be held legally responsible for
<br />the violation.
