<br /> 68 <br /> Regular Meeting April 8, 1985 Page 4 <br /> Mayor Craddock introduced for consideration approval of an Ordinance <br /> on second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, REPEALING CHAPTER 3 OF THE CODE OF <br /> ORDINANCES OF SAID CITY IN ITS ENTIRETY AND SUBSTITUT- <br /> ING THEREFOR A NEW CHAPTER 3, ANIMALS AND FOWL, OF THE <br /> CODE OF ORDINANCES OF SAID CITY DEFINING TERMS; PROHIBIT- <br /> ING THE KEEPING OF HOGS, ETC.; PROHIBITING LIVESTOCK FROM <br /> RUNNING AT LARGE; PROHIBITING THE SALE AND GRAZING, ETC., <br /> OF LIVESTOCK UPON STREETS, ALLEYS, ETC.; REQUIRING MAIN- <br /> TENANCE OF CLEAN AND SANITARY LIVESTOCK PENS; PROHIBIT- <br /> ING FOWL FROM RUNNING AT LARGE AND REQUIRING MAINTENANCE <br /> OF SANITARY PENS AND CAGES THEREFOR; REQUIRING PHYSICAL <br /> RESTRAINT OF DOGS; PROHBITING UNREASONABLE LOUD BARKING <br /> OR HOWLING NOISE BY DOGS; REQUIRING REMOVAL OF DOG FECES <br /> FROM PUBLIC AND PRIVATE PROPERTY; PROVIDING FOR ISSUANCE <br /> OF CITATIONS; REQUIRING REGISTRATION OF DOGS AND SETTING <br /> FORTH PROCEDURES THEREFOR AND FOR REVOCATION THEREOF; <br /> PROVIDING FOR IMPOUNDlI1ENT OF ANIMALS AND SETTING FORTH <br /> CRITERIA AND PROCEDURES THEREFOR; PROVIDING FOR PENALTY <br /> AND DECLARING AN EFFECTIVE DATE. <br /> Mrs. Nina pryatel and Mr. George VonderLippe offered their support of <br /> the adoption of this Ordinance. Mayor Craddock moved for approval of <br /> the Ordinance on second reading and Mr. Farr seconded the motion. Mr. <br /> Brown moved to amend the Ordinance in Section 3-18 following the second <br /> complete sentence ending" . . . to a person or persons in the vicinity <br /> of the dogll to add IIAny such person or persons so disturbed must file <br /> a sworn, written complaint with the appropriate authorities to initiate <br /> prosecution under this section". Mr. Coddington seconded the motion. <br /> Mr. Coddington then moved to amend the Ordinance in Section 3-29 to <br /> read as follows: liThe registration issued under this Division 2 shall <br /> run from the date of licensing for 12 months". Mr. Guerra seconded the <br /> motion. The Council then voted unanimously for approval of Mr. Brown's <br /> motion and Mr. Coddington's second. The Council voted unanimously for <br /> approVJal of Mr. Coddington's amendment and Mr. Guerra's second. On roll <br /> call for approval of the Ordinance on second reading, the following vote <br /> was recorded: <br /> AYE: Brown, Coddington, Farr, Craddock Guerra. <br /> NAY: Moore. <br /> ABSTAIN: None. <br /> Mayor Craddock introduced for consideration approval of an Ordinance <br /> on second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE PROJECT PLAN AND FINANC- <br /> ING PLAN OF REINVESTMENT ZONE NUMBER ONE, CITY OF <br /> SAN MARCOS, TEXAS; PROVIDING A SAVINGS CLAUSE; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> Mr. Guerra moved for approval of the Ordinance on second reading and <br /> Mr. Coddington seconded the motion. Mr. Coddington stated in Article <br /> II, Section 3 on Page 6, Accrued Interest, was it possible to have a <br /> good faith type payment in lieu of the wording presented, and wording <br /> is to be presented to the Council at third reading. The Council then <br /> voted unanimously for approval of the Ordinance on second reading. <br />
