<br /> 65 <br /> THE STATE OF TEXAS § <br /> COUNTY OF HAYS § <br /> INTERIDCAL i'iGREENENT BETWEEN <br /> THE CITY OF SAN HARCOS, TEXAS AND HAYS mUNTY, TEXAS <br /> THIS I NTERIDCAL AGREE'v1ENT (this "Þgreement") dated as of October <br /> 15, 1984 betvleen the City of Sa.n Harcos, Texas, a municipal <br /> corporation duly incorporated under the Constitution and laws of the <br /> Sta te of Texas (the "City"), acting by and through its City Council <br /> (the "Ci ty Counc il" ), and Hays County, Texas, a political subdivision <br /> of the State of Texas (the "County" ), acting by and through its <br /> Commissioners Court (the "Corrmissioners Court"), <br /> WI'INESSE'IR: <br /> WHEREAS, pursuant to the Interlocal Cooperation Act, Article 4413 <br /> (32c), Vernon's Texas Civil Statutes, as amended (the "Act"), cities <br /> and counties of the State of Texas are authorized to enter into <br /> intergovernmental contracts regarding governmental functions and <br /> services as further set forth in the Act; <br /> WHEREi\S, the County owns that certain tract of land located within <br /> the city limits of the City on which is located the Hays County Jail <br /> (the "Jail"), which tract is further described by metes and bounds on <br /> Exhibit A hereto (the "Jail Tract"); <br /> ~lliEREAS, the County also owns that certain tract of land located <br /> within the city limits of the City on which is located the abandoned <br /> Hays County Hemorial Hospital, which tract is further described by <br /> metes and bounds on Exhibit B hereto (the "Hospital Tract") ; <br />
