<br /> WHEREAS, the Jail Standards Commission of the State of <br /> Texas (the "Commission") has determined that the Jail is inade- <br /> quate to serve the correctional requirements of the County, the <br /> City, and the surrounding region and by Order dated March 28, <br /> 1984 has directed the County to expand the Jail to meet the <br /> requirements of State law (the "Jail Expansion"); <br /> WHEREAS, the County expects to undertake the issuance <br /> of bonds, certificates of obligation, or other form of <br /> indebtedness of the County to provide funds for the Jail <br /> Expansion pursuant to a financing program (the "Financing <br /> Program") involving the concurrent development of the Hospital <br /> Tract to provide funds to the County in such amounts and on such <br /> dates as will pay all or substantially all of the cost of the <br /> retirement of such indebtedness, and the Commission has approved <br /> the concept of the Financing Program for the Jail Expansion; <br /> WHEREAS, the undertaking of the Jail Expansion, includ- <br /> ing the development of the Hospital Tract in connection there- <br /> with, will require wastewater service to be made available by the <br /> City to the Jail Tract and the Hospital Tract to enable the <br /> County to construct adequate facilities on such Tracts to com- <br /> plete the Jail Expansion and the Financing Program; and <br /> WHEREAS, the City and the County have determined to <br /> enter into this Agreement in order that the County may design and <br /> utilize wastewater service lines to the Jail Tract and the <br /> Hospital Tract determined on a living unit equivalent ("LUE") <br /> -2- <br />
