<br /> C-481464-03-0 <br /> PART III-AWARD CONDITIONS <br /> -i" <br /> 8. GENERAL CONDITIONS <br /> The recipient covenants and agrees that it will expeditiously initiate and timely complete the project work for <br /> which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CFR <br /> Chapter I, Subpart B. The recipient warrants, represents, and agrees that it, and its contractors, subcontractors, <br /> employees and representatives, will comply with: (1) all applicable provisions of 40 CFR Chapter I, Subchapter B, <br /> INCLUDING BUT NOT LIMITED TO the provisions of Appendix A to 40 CFP Part 30, and (2) any special <br /> conditions set forth in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425. <br /> b. SPECIAL CONDITIONS: <br /> (For cooperative agreements include identification or summarization of EP A responsibilities that reflect or <br /> contribute to substantial involvement.) <br /> 1. The Environmental Protection Agency (EPA) in accordance with 40 CFR <br /> Part 30 Subpart C, 40 CFR Part 33; and 40 CFR Part 35 Subpart I, <br /> reviews, approves and monitors all actions taken by the recipient <br /> during performance of this Assistance Agreement. EPA may immediately <br /> halt or terminate this agreement if the recipient fails to meet the <br /> requirements of the above regulations. <br /> In addition to the EPA General Grant Conditions, each treatment <br /> works grant shall be subject to the conditions under 40 CFR <br /> 35.2202 through 35.2218, a copy of which is attached and hereby <br /> made a part of this Agreement (see Attachment A). <br /> 2. No portion of this award may be used for lobbying or propaganda <br /> purposes as prohibited by 18 USC Section 1913 or Section 607(a) <br /> of PL 96-74. <br /> 3. The recipient agrees to take the affirmative steps shown in <br /> Attachment 0 to OMB Circular A-I02 and 40 CFR 33.240 to assure <br /> that small, minority and women's businesses are used when possible <br /> as sources of supplies, construction and services. <br /> 4. The recipient agrees to abide by regulations 40 CFR Part 8 and <br /> 40 CFR Part 33, Subpart F, in regard to Equal Employment Opportunity. <br /> 5. Bid tabulation and supporting documents will be prepared and <br /> furnished to the State Agency within 30 days of bid opening. The <br /> bid holding period between bid opening and contract award will be <br /> no longer than 90 days. <br /> 6. The recipient shall expeditiously initiate and complete the project <br /> in accordance with the following project schedule: <br /> Task Date <br /> - - <br /> Submit Plans and Specifications 35 days after date of <br /> grant awa rd <br /> Submit proposed User Charge System 35 days after date of <br /> and Sewer Use Ordinance grant award <br /> Advertise for Bids Within 15 days after <br /> Authorization to Advertise <br /> Award Contract Within 90 days after <br /> bid opening <br /> Start of Construction Within 30 days after <br /> award of contract <br /> Submit final Plan of Operation By 50% payment of building <br /> costs <br /> Submit Operation and Maintenance Manual By 90% payment of building <br /> costs <br /> E P A Form 5700-20A (Rev. 8-79) PAGE 3 OF f <br />
