The allowance will be paid in accordance with 40 CFR 35.2300 and <br /> Appendix B to 40 CFR Part 35, Subpart I (see Attachment A to this <br /> Agreement). <br /> The recipient will request payment monthly for Step 3 work, <br /> except for final payment of allowable building costs which <br /> will be requested within 60 days following final inspection <br /> of bui 1 di ng. <br /> At no time shall such requests exceed the Federal share of the <br /> cost of construction incurred, plus the value of eligible materials <br /> on hand, less retainage. <br /> 8. Any work performed, or costs incurred, outside the approved budget <br /> period will not be allowable for Federal participation unless the <br /> budget period is extended by State and EPA approval of the grant <br /> recipient's properly justified request for extension. <br /> 9. If any historical or archeological sites are discovered during construction, <br /> work will cease in that area and the recipient will notify EPA of the <br /> di scovery. EPA shall then proceed in accordance with the regulations <br /> of the Advisory Council on Historic Preservation (36 CFR Part 800). <br /> 10. Should either endangered or threatened plant or animal species be <br /> encountered during construction, work will cease in that area and <br /> the recipient will notify EPA of the discovery. EPA shall then <br /> proceed in accordance with the Endangered Species Act of 1978, <br /> as amended. <br /> 11. 1. The recipient agrees that no wastewater generated by development <br /> located in the 100-year floodplain, as delineated on the attached map, <br /> shall be transported or treated by the project facilities for a period <br /> of 50 years. This restriction does not apply to development which, by its <br /> nature, must be located on or adjacent to water (e.g., a marina) or which <br /> existed (as defined by EPA Region 6 Construction Grants Floodplain Guidelines, <br /> rev. January 12, 1982) prior to May 10, 1982. <br /> Page L of L- <br />
