<br />97 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting April 22,1985 Page 4 <br /> <br /> <br />Mayor Craddock introduced a public hearing and consideration of Ordi- <br />nance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES ANDREST~ICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY CHANGING THE ZONING OF 9.754 ACRES <br />OUT OF THE THOMAS JEFFERSON CHAMBERS SURVEY, ABSTRACT <br />NO.2, HAYS COUNTY, TEXAS, AND LYING WITHIN THAT TRACT <br />CONVEYED BY T. D. WILLIAMSON, MARY WILLIAMSON, BILLIE <br />JEAN HAGY, DAVID HAGY, NANCY GRIER, WALTER GRIER, BILLY <br />ARMSTRONG, ROSLYN ARMSTRONG, RICHARD ARMSTRONG, BARRY <br />ARMSTRONG, AND REBECCA ARMSTRONG TO WILLIAM J. LOWMAN,II <br />BY THAT DEED DATED 15 DECEMBER 1980, FILED 20 JANUARY <br />1981, AND RECORDED 21 JANUARY 1981 IN VOLUME 352, PAGES <br />422-429 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, LOCATED <br />IN THE VICINITY OF THE WEST INTERSECTION OF PROSPECT AND <br />COLUMBIA STREETS, FROM "R-l" (SINGLE-FAMILY DWELLING DIS- <br />TRICT) TO "ZL" (ZERO LOT LINE DISTRICT) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Craddock declared the public hearing open and asked if anyone <br />wished to speak in favor of the Ordinance. No one did. She then <br />asked if anyone wished to speak against the Ordinance. No one did. <br />Mayor Craddock declared the public hearing closed. Ms. Kissler moved <br />to approve the Ordinance on first reading and Mr. Brown seconded <br />the motion. Mr. Coddington asked if this was the same situation <br />where the density would allow for more than six units per acre, and <br />Mr. Robbins replied yes it was. Mr. Ralph Ramirez approached the <br />podeum and discussed the flexibility of zero lot line to the Council. <br />Mr. Robbins recommends that the Ordinance be approved and that the <br />applicant, Mr. Ramirez, will work together with the Staff. Mr. <br />Brown moved to amend the Ordinance to include the following language <br />and Mr. Nicola seconded the motion which passed unanimously. The <br />language to be included in the Ordinance reads as follows: <br /> <br />"SECTION 2: That the property described in Section 1 above <br />shall be developed at a gross average density of no more <br />than six (6) units per acre." <br /> <br />The Council then voted unanimously to approve the Ordinance on first <br />reading as amended. <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />t~RCOS, TEXAS, ABANDONING AND VACATING A PORTION OF <br />A FIFTEEN FOOT (15') WIDE ALLEY, THE SOUTHEAST LINE <br />OF WHICH ADJOINS THE NORTHWESTERN BOUNDARY, OF W. A. <br />THOMPSON'S ADDITION TO THE CITY OF SAN MARCOS, TEXAS; <br />AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE A SPECIAL <br />WARRANTY DEED; REFLECTING PAYMENT OF THE FAIR MARKET <br />VALUE OF $250.00; PROVIDING FOR THE REVERSION OF FEE IN <br />SAID LAND AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Coddington moved to approve the Ordinance on first reading and <br />Mr. Farr seconded the motion. Mr. Farr then moved to amend the <br />Ordinance to allow it to pass on emergency and Mr. Coddington <br />seconded the motion which passed unanimously. The Council then voted <br />unanimously to approve the Ordinance on emergency as amended. <br />
