<br />96 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting April 22,1985 Page 3 <br /> <br /> <br />IN COMMISSIONER'S COURT RECORDS, VOLUME L, PAGES 41-42, <br />CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, A/K/A 2211 <br />NORTH BISHOP, FROM "R-l" (SINGLE-FAMILY DWELLING DISTRICT) <br />TO "R-2" (SINGLE-FAMILY DWELLING DISTRICT) AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Craddock declared the public hearing open and asked if there <br />was anyone to speak in favor of the Ordinance. No one did. She then <br />asked if there was anyone wished to speak against the Ordinance. No <br />one did. Mayor Craddock declared the public hearing closed. Mr. <br />Coddington moved to deny the Ordinance. There was no second. The <br />motion failed. Mayor Craddock moved to approve the Ordinance on first <br />reading and Mr. Coddington seconded the motion. Mr. Coddington expressed <br />concern to the exit at Chicago Street on to Bishop whereas the increased <br />traffic flow from six to nine in the density. He further stated that <br />there had been more changes. The Staff report recommended "R-l" preferable <br />to "R-2" which the Commission passed. Mr. Coddington asked if low den- <br />sity was at 6 units. Mr. Frank Robbins stated that "R-l" could be built <br />with 6 units, and that "R-2" could also be built with 6 units up to 9 units <br />per acre. In this case, designation of 6 units per acre would rule, and <br />when the property was to be platted if it exceeded 6 units per acre it was <br />unlikely to be passed by the Commission. Mr. Pud Rutledge took the <br />podeum and stated that on his application he indicated that "R-2" would <br />be limited to no more than six units per acre, which would be his only <br />intention. Mr. Farr moved to amend the Ordinance to include the following <br />language and Ms. Kissler seconded the motion which passed unanimously. The <br />language reads as follows: <br /> <br />nSECTION 2: That the property described in Section 1 above shall <br />be developed at a gross average density of no more than six (6) <br />units per acre." <br /> <br />The Council then proceeded to vote on the Ordinance on first reading <br />.8,samende:d. On roll call. the f.ollowing vote was recorded: <br /> <br /> <br />AYE: Brown, Farr, Craddock, Kissler, Nicola <br /> <br />NAY: Coddington <br /> <br />ABSTAIN: None <br /> <br />Mayor Craddock introduced a public hearing and consideration of Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAR- <br />COS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED JUNE 13, 1984, (VOL.66) BY <br />CHANGING THE ZONING OF 20.49 ACRES, MORE OR LESS, OF LAND <br />AREA IN THE J. M. VERAMENDI LEAGUE, SURVEY NO.1, HAYS <br />COUNTY, TEXAS, BEING A PORTION OF THAT 39.27 ACRE TRACT <br />AS DESCRIBED IN A CORRECTION DEED FROM RUSSELL C. AYERS. <br />ET AL, TO DAVID S. MINTER, TRUSTEE, DATED JANUARY 30, 1984 <br />AS RECORDED IN VOLUME 424, PAGE 184, OF THE HAYS COUNTY <br />DEED RECORDS, BEING IN THE 2600 BLOCK OF IH 35 SOUTH AND IN <br />THE VICINITY OF THE INTERSECTION OF CLOVIS BARKER DRIVE AND <br />IH 35 SOUTH, FROM "I" (INDUSTRIAL DISTRICT) TO "c" (COM- <br />MERCIAL DISTRICT) AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock declared the public hearing open and asked if there was <br />anyone to speak in favor of the Ordinance. No one did. She then asked <br />if anyone wished to speak against the Ordinance. No one did. Mayor <br />Craddock declared the public hearing closed. Mr. Farr moved for ap- <br />proval of the Ordinance on first reading and Ms. Kissler seconded the <br />motion which passed unanimously. <br />
