115 Special Meeting April 29, 1985 Page 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 30-7 OF ARTICLE I OF CHAPTER 30 OF THE CODE OF ORDINANCES OF SAID CITY TO INCREASE THE AMOUNT OF DEPOSITS FOR ALL NEW CONNECTIONS FOR UTILITY SERVICES TO INDIVIDUALLY METERED RESIDENTIAL UNITS TO $35.000 AND TO COMMERCIAL ESTABLISHMENTS AND ALL RESIDENTIAL UNITS NOT METERED INDIVIDUALLY TO TWO (2) TIMES THEIR ESTIMATED AVERAGE MONTHLY BILL OR $60.00, WHICHEVER IS GREATER; AND DECLARING AN EFFECT- IVE DATE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 17 OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING SECTION 17-7 PROVIDING FOR ANNUAL EVALUATIONS OF MUNICIPAL COURT JUDGES; ESTABLISHING CRITERIA FOR THOSE EVALUATIONS; AND, DE- CLARING AN EFFECTIVE DATE. Mayor Craddock introduced a discussion of the Municipal Utility Dis- trict (MUD) review process. Frank Robbins introduced Drs. Bill Lang- ford and Kent Butler. Mr. Robbins stated the l20-day process period had not yet started, because the City's Ordinance requires a 60-day pre-application process. Two requests for MUDs have been received by the City, Project 514, consisting of 514 acres, and River Gate (Storm), consisting of 1,344 acres, both located off of IH35 North of San Marcos. Project 514 thinks they are in the l20-day process and River Gate agrees to withdraw its petition and follow the City's process. Dr. Kent Butler reviewed four options of MUDs with the Council: (1) consent agreement; (2) consent agreement with conditions proposed by the Council; (3) annexation of the lands; and (4) annexa- tion and providing of services at the level a MUD would create and within 2-1/2 years to begin providing service as provided to other citizens. He also stated some of the common conditions set by Cities are as follows: (1) limits on bond financing and timing of bond is- suance; (2) levying of capital recovery fees; (3) conditions on land use proposals; and (4) provision of utility services, such as overage agreements, etc. Mr. Guerra moved the Council adjourn into Executive Session pursuant to Article 6252-17, §2(e), V.A.C.S., to seek the City Attorney's advice with respect to matters where the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17 (negotiation of contracts, discussion of City's legal position in administrative matters). Mr. Farr seconded the motion, which passed unanimously (9:54 p.m.). Mr. Guerra moved the Council reconvene at 10:45 p.m. and Mr. Brown seconded the motion, which passed unanimously.
