<br />115 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Special Meeting April 29, 1985 Page 3 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 30-7 OF ARTICLE I OF <br />CHAPTER 30 OF THE CODE OF ORDINANCES OF SAID CITY TO <br />INCREASE THE AMOUNT OF DEPOSITS FOR ALL NEW CONNECTIONS <br />FOR UTILITY SERVICES TO INDIVIDUALLY METERED RESIDENTIAL <br />UNITS TO $35.000 AND TO COMMERCIAL ESTABLISHMENTS AND <br />ALL RESIDENTIAL UNITS NOT METERED INDIVIDUALLY TO TWO <br />(2) TIMES THEIR ESTIMATED AVERAGE MONTHLY BILL OR <br />$60.00, WHICHEVER IS GREATER; AND DECLARING AN EFFECT- <br />IVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 17 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY ADDING SECTION 17-7 PROVIDING <br />FOR ANNUAL EVALUATIONS OF MUNICIPAL COURT JUDGES; <br />ESTABLISHING CRITERIA FOR THOSE EVALUATIONS; AND, DE- <br />CLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock introduced a discussion of the Municipal Utility Dis- <br />trict (MUD) review process. Frank Robbins introduced Drs. Bill Lang- <br />ford and Kent Butler. Mr. Robbins stated the l20-day process period <br />had not yet started, because the City's Ordinance requires a 60-day <br />pre-application process. Two requests for MUDs have been received <br />by the City, Project 514, consisting of 514 acres, and River Gate <br />(Storm), consisting of 1,344 acres, both located off of IH35 North <br />of San Marcos. Project 514 thinks they are in the l20-day process <br />and River Gate agrees to withdraw its petition and follow the City's <br />process. Dr. Kent Butler reviewed four options of MUDs with the <br />Council: (1) consent agreement; (2) consent agreement with conditions <br />proposed by the Council; (3) annexation of the lands; and (4) annexa- <br />tion and providing of services at the level a MUD would create and <br />within 2-1/2 years to begin providing service as provided to other <br />citizens. He also stated some of the common conditions set by Cities <br />are as follows: (1) limits on bond financing and timing of bond is- <br />suance; (2) levying of capital recovery fees; (3) conditions on land <br />use proposals; and (4) provision of utility services, such as overage <br />agreements, etc. <br /> <br />Mr. Guerra moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §2(e), V.A.C.S., to seek the City Attorney's advice <br />with respect to matters where the duties of the City Attorney to the <br />City pursuant to the Code of Professional Responsibility of the State <br />Bar of Texas clearly conflicts with Article 6252-17 (negotiation of <br />contracts, discussion of City's legal position in administrative <br />matters).
